Committee for Marshall – Not the Megasite Case Heard in Calhoun County Circuit Court
Marshall, MI – A hearing on the Committee for Marshall - Not the Megasite’s case against the City of Marshall and Marshall Area Economic Development Alliance (MAEDA) was heard in Calhoun County Circuit Court before the Honorable Judge William Marietti on August 9, 2023. Our attorney, Robert Dube, came well prepared and argued strongly on all merits of the case.
During the hearing, City of Marshall and MAEDA attorneys made no attempt to explain their authority for violating the constitutional rights of the signature gatherers.
The City of Marshall and MAEDA attempted to delay the hearing by filing numerous motions to unilaterally change the date of the hearing and reject the Committee’s opposition brief. The Court rejected these motions, but will allow them each a Response Brief, as they did not come prepared. These City of Marshall and MAEDA responses to the Committee’s opposition brief must be filed by August 20.
A ruling by the Court is expected shortly after the response briefs are filed.
If the court rules in our favor, the rezoning will be suspended until an election can be held.

Where We Have Been and Where We are Headed
� Organized as a legal Ballot Question Committee
� Developed a petition for collecting signatures (11 versions)
� Worked with area 40 residents to collect signatures
� Held petition signing events and organized people going door to door to collect signatures is less than 30 days
� Submitted 810 signatures in effort to bring Megasite rezoning to a vote of the people – giving a voice to the residents!
� Retained Eckland & Blando law firm to represent us in our legal battle to force the City of Marshall to let the voters decide on the rezoning
� Fundraising for initial retainer
� Filed lawsuit in late June
� Had first hearing on July 12
� Fought in court against intervention from Ford, MEDC, MCJO, MAEDA, and Michigan Strategic Fund (MAEDA was allowed to intervene)
� Multiple FOIA requests to the City
� Raised just over $30,000 thus far with a financial need of approximately $70,000. � Coordinate media coverage of petition submission and legal proceedings � Filed an amendment to our petition as a method to present additional evidence to the Court.
� Awaiting ruling from the Court from the August 9 hearing
� Continue to incur legal costs due to actions by MAEDA and City of Marshall.
