The Issue

Every child deserves to feel safe at school. Every parent deserves peace of mind. And every child deserves a voice, even when they cannot communicate what has happened to them.

Across Virginia, children with disabilities attend school every day, placing their safety and well-being in the hands of educators and school personnel. For families whose children have significant communication challenges, sending a child to school requires an extraordinary level of trust.

When a child cannot explain what happened during the school day, parents may never know if their child experienced bullying, mistreatment, neglect, or an unsafe situation.

Silence should never mean vulnerability.

We are calling on the Virginia General Assembly to introduce and pass legislation establishing video camera requirements in special education classrooms throughout Virginia, particularly those serving children with significant communication and support needs.

Protecting Children Who Cannot Defend Themselves

One of our greatest concerns involves children who cannot effectively communicate or defend themselves when serious allegations arise.

Imagine a child with significant communication challenges being accused of an act that could result in severe disciplinary action or even legal consequences. If that child cannot explain what happened, their future may depend heavily on someone else’s account of the incident.

No child’s safety, reputation, education, or future should rest solely on their ability to speak or defend themselves.

While teachers and school personnel provide valuable accounts of classroom incidents, those accounts should not always be the only evidence available when serious allegations arise.

Video recordings, when available and appropriately reviewed, could provide valuable independent evidence, help establish the facts, and protect both students and educators from wrongful accusations.

Every child deserves a fair and impartial investigation, regardless of their ability to communicate.

Protecting Students and Educators

This petition is not an accusation against teachers or school personnel. Many educators work tirelessly to support children with disabilities.

Our goal is to establish additional safeguards that protect students from abuse, bullying, neglect, and unsafe situations while also protecting dedicated educators when incidents or allegations arise.

Cameras would not replace proper staffing, supervision, training, or the protections established under a child’s Individualized Education Program (IEP). They would provide an additional layer of accountability and transparency.

What We Are Asking Virginia Lawmakers to Do

We urge the Virginia General Assembly to:

 1. Establish video monitoring requirements in special education classrooms throughout Virginia, prioritizing classrooms serving children with significant communication and support needs.

 2. Protect student and staff privacy by prohibiting cameras in bathrooms, changing areas, and other spaces where personal privacy is expected.

 3. Require secure storage of recordings with strict confidentiality protections and appropriate retention periods.

 4. Establish clear procedures for reviewing footage when allegations of abuse, neglect, bullying, serious misconduct, or other significant safety incidents arise.

 5. Protect against retaliation when students, families, or school employees report legitimate safety concerns.

 6. Provide statewide implementation standards and fundingso schools can comply without sacrificing essential educational resources.

 7. Ensure fair and impartial investigations so that children who cannot communicate effectively are not left without meaningful evidence when serious allegations arise.

Our Children Deserve More Than Promises

For children who cannot always tell us what happened, safety should never depend entirely on someone else’s account.

Families should not have to choose between trusting their child’s school and advocating for greater accountability.

We recognize that cameras cannot prevent every incident or capture every detail. However, appropriately managed recordings can provide an important additional source of evidence when questions arise.

A child’s inability to speak should never mean an inability to be heard.

We urge Virginia lawmakers to take meaningful legislative action to strengthen protections for children with disabilities while respecting the rights and privacy of students and educators.
