Across the United States, thousands of households depend on an unpaid primary caregiver to support disabled adults, medically fragile family members, or individuals requiring continuous care. These caregivers are often prevented from maintaining independent employment due to the demands of full-time medical support.

 

When that caregiver is financially dependent on another household member who controls insurance, transportation, medical access, or essential resources, the caregiver becomes uniquely vulnerable to a form of abuse that is largely invisible under current law:

medical and financial coercive control.

 

This form of coercion does not always leave bruises. Instead, it produces:

 

Delayed or denied medical care
Loss of vision, mobility, and neurological function
Progressive untreated disease
Exhaustion and system failure
Increased risk of catastrophic injury or death

 

Yet under existing domestic violence and disability statutes, this pattern is rarely recognized as actionable abuse unless extreme physical violence already occurs.

 

This creates a dangerous legal blind spot:

the caregiver who is medically deteriorating while still carrying the full burden of another person’s survival.

Current law generally requires:

 

Physical assault
Explicit threats of violence
Or criminal financial fraud

 

to trigger meaningful intervention.

 

It does not clearly recognize:

 

Withholding access to healthcare
Denial of insurance coverage
Obstruction of transportation to medical care
Forced economic dependency
Or medical neglect through inaction

as standalone forms of coercive abuse when they result in documented medical harm to a dependent caregiver.

We call upon lawmakers to formally recognize and protect against:

Insurance
Transportation for medical care

Disability-Dependent Households

Households where at least one person requires continuous medical assistance and the caregiver’s health directly determines survival and safety.

Pattern-Based Harm Recognition

Recognition that harm may present as:

Progressive neurological decline
Vision loss

Cardiac instability
Autoimmune deterioration
Or permanent disability

Protective Standing for Caregivers

Allowing courts to issue:

Protective orders
Emergency medical access
Temporary independent insurance eligibility
Transitional financial support
before irreversible injury occurs

 

 

🏥 MANDATORY REPORTING PROTECTIONS

 

We also call for mandatory reporting protections for:

 

Physicians
Physical therapists
Occupational therapists
Social workers
Mental health providers

 

when they document caregiver deterioration consistent with coercive medical or financial control.
