Protect cottage food businesses in Nevada

The Issue

In Nevada, cottage food businesses have become a vital part of our communities. These home-based enterprises provide an opportunity for entrepreneurs, particularly those who may not have the resources to start a traditional retail business, to generate income and share their culinary talents with neighbors and beyond. Unfortunately, current regulations do not adequately protect these businesses, especially when it comes to allowing customer pickups directly from residential locations.

Imagine a grandmother in Las Vegas who bakes the most incredible sourdough bread, selling it to friends and neighbors who eagerly await each loaf. She operates under strict cottage food regulations, ensuring her kitchen meets safety standards and her ingredients are locally sourced and fresh. However, without the ability to offer scheduled pickups, she faces unnecessary challenges that hinder her ability to grow her business and serve the community effectively.

The current legal framework permits cottage food businesses to prepare and sell their goods from home but fails to clearly support their ability to arrange for home-based pickup under regulated conditions. This leaves entrepreneurs like her vulnerable to misclassification as traditional retailers, potentially facing penalties or forced closures. According to the Nevada Revised Statutes, these small businesses are distinct from large-scale operations and should be treated as such, with clear guidelines that recognize their unique nature and contributions.

Introducing fair and reasonable regulations for residential pickups would not only offer convenience to customers who prefer personal interaction and lower delivery costs but also empower local business owners to maintain and expand their market reach. It aligns with Nevada's support for small businesses and could lead to increased local economic activity while preserving the personal touch that makes each cottage business unique.

We urge Nevada lawmakers to design and implement a policy that explicitly grants registered cottage food businesses the right to host scheduled pickups from their homes. This must be done with appropriate safety and compliance measures in place, ensuring both the public's health and the entrepreneur’s right to operate without unnecessary restrictions.
