The Issue

To the Mayor and Governing Body of the City of Cherryvale, Kansas:

We, the undersigned residents, property owners, water customers, taxpayers, and concerned members of the Cherryvale-area community respectfully petition the City of Cherryvale to not approve, subsidize, contract for, or commit City water or other City resources to the proposed hyperscale data center unless and until the public has received complete, independently verifiable information about the project’s maximum impacts and enforceable protections have been established.

We are asking City officials to address the following issues before making commitments that could affect Cherryvale and the surrounding community for decades:

Protect Big Hill Lake and Our Water Supply

Require an independent water-supply study addressing Big Hill Lake, existing municipal demand, drought conditions, evaporation, dependable water supply, maximum daily and annual data-center withdrawals, future expansion, and mandatory drought and emergency curtailment.

The public deserves to know the project’s maximum water requirement, not simply its initial requirement.

Disclose Cooling Systems, Chemicals and Discharge

Require full public disclosure of the proposed cooling system, water-treatment chemicals, wastewater or discharge, concentrated waste streams, required permits, and monitoring procedures.

Protect Nearby Residents From 24/7 Noise

Require independent noise modeling that considers cooling equipment, transformers, backup generators, electrical equipment, and other continuous sources.

Establish enforceable daytime and nighttime noise limits that protect nearby homes, farms, and rural property.

Require Full Financial Transparency

Disclose proposed tax abatements, incentives, rebates, infrastructure improvements, utility commitments, water-system improvements, road improvements, and other public costs.

Residents deserve to know who pays for the infrastructure necessary to serve this development.

Verify Jobs and Economic-Benefit Claims

Require written documentation supporting projected permanent local jobs, wages, tax revenue, and other claimed long-term economic benefits.

Permanent employment should be clearly distinguished from temporary construction jobs.

Require Public Transparency Before Approval

Identify the developer and eventual operator when legally permitted and make material development and utility agreements available for public review to the extent required or permitted by law.

Residents should have adequate time to examine major agreements before final government action.

Establish Binding Long-Term Protections

Any agreement involving the proposed hyperscale data center should contain enforceable protections addressing:

Maximum water consumption
Future expansion
Drought and emergency water restrictions
Noise
Environmental compliance
Wastewater and discharge
Infrastructure responsibilities
Emergency response
Ownership changes
Enforcement and consequences for violations
Our Request

We respectfully ask the City of Cherryvale to withhold final approvals and extraordinary City commitments for the proposed hyperscale data center until these questions have been independently evaluated, the results have been made available to the public, and appropriate legally enforceable protections have been established.

Projects of this size can affect water, infrastructure, land use, public finances, and neighboring property owners for decades.

Cherryvale residents deserve complete information before irreversible commitments are made.

Please sign this petition and share it with residents, property owners, water users, and others concerned about the future of Cherryvale and Big Hill Lake.

This is a community petition expressing a request to public officials. It is separate from, and should not be represented as satisfying the requirements of, a statutory initiative petition under K.S.A. 12-301
