Protect American Jobs: End Visa Fraud and Exploitation

The Issue

Every day, more Americans are being pushed out of the workforce in their own country. People who worked hard, paid their taxes, and built this nation are being shown the door, while corporations exploit visa loopholes to cut costs. Families are losing homes. Recent graduates are left with student debt and no job offers. Entire communities are collapsing as local businesses lose customers and tax bases shrink.

This isn’t just about money. It’s about fairness, dignity, and the survival of the American middle class.

Visa programs were never meant to be a replacement for American workers. They were supposed to fill rare, specialized gaps. Instead, they’ve become a tool for outsourcing, undercutting wages, and sidelining U.S. citizens. Meanwhile, Americans who dare to speak out are silenced, retaliated against, or blacklisted.

And while this goes on, Congress has failed to act.

We demand immediate action to restore fairness and accountability.

What must be done:

1. Stricter Penalties for Abuse. Companies caught exploiting visa loopholes should face real consequences: heavy fines, loss of visa privileges, and criminal accountability at the executive level.
2. Full Transparency. Require companies to make their visa use public, who is applying, how many workers are brought in, and in what roles—so citizens can see the truth for themselves.
3. SEC Reporting of Job Impact. Mandate that publicly traded companies report in their SEC filings:

  1. How many American jobs were lost or replaced.
  2. How many projects were offshored or nearshored.
  3. How much profit was made through these practices.

No more hiding the numbers. Shareholders, employees, and the public have a right to know.

4. Protect American Whistleblowers. U.S. citizens who step forward with evidence of discrimination, retaliation, or visa fraud must be protected, not punished.
5. Agency Cooperation. DHS, DOJ, state attorneys general, and labor organizations must coordinate to track, investigate, and prosecute fraud at every level.
6. Put Americans First. Before any visa is approved, companies must prove, through independently verified evidence, that no qualified American applied or was available.

7. End fake, scam, and ghost job postings. Impose strict penalties — including significant fines and potential criminal liability for executive leadership — when companies are found guilty of engaging in these practices
 

8. The H-1B to Green Card backlog should be immediately canceled — the H-1B is, by definition, a non-immigrant visa.


Every day without reform means more families pushed into crisis, more students graduating into dead ends, more towns and cities left behind.

Congress must act now. Americans deserve fair treatment, fair pay, and a future in their own country.
