Protect All Trans Women in Federal Prison — Not Just the 14 Covered by This Ruling
The Issue
A federal judge just blocked the Trump administration from transferring 14 transgender women from women's prisons to men's prisons — ruling that doing so would constitute cruel and unusual punishment and mark each woman as a target for rape and violence.
But the ruling only protects those 14 women. Hundreds more face the same danger.
Since January 2025, the Bureau of Prisons has been implementing Trump's executive order requiring all federal prisoners to be housed based on their sex assigned at birth — regardless of the danger that creates. Trans women who have lived in women's facilities for years, many of whom have undergone hormone therapy and surgery, are being transferred into men's prisons where experts say the risk of sexual violence is well documented and not meaningfully disputed among corrections professionals.
The judge was explicit: transferring these women marks them as targets. It exacerbates gender dysphoria. It increases the risk of self-harm and suicidality. It is cruel and unusual punishment.
That finding does not apply to just 14 women. It applies to every trans woman the Bureau of Prisons is threatening to transfer.
We're calling on the Federal Bureau of Prisons to immediately halt all transfers of transgender women from women's prisons to men's prisons and house every incarcerated person in the facility that matches their gender identity — not their sex assigned at birth.
