Studierende des Studiengangs IBWL, IBA und Wirtschaft und Recht/ Recht und Wirtschaft schrieben am 26.02.2021 eine Klausur in dem Modul Wirtschaftsinformatik, welches in allen Studiengängen Teil des Grundstudiums ist. Die Prüfungsbedingungen der Klausur waren eine reine Onlinedurchführung im Open-Book-Format unter der Voraussetzung, dass die Kommunikation der Studierenden untereinander während der Klausur strikt untersagt ist. Die Prüfung bestand aus einem Anwendungsteil (60% der Punkte) und einem Theorieteil in Form von Ja/Nein Fragen (40% der Punkte). Diese Klausur wurde am 11.03.2021 auf Antrag des verantwortlichen Professors durch den Prüfungsausschuss annulliert. Zu erwähnen ist dabei, dass der verantwortliche Professor auch Teil des Prüfungsausschusses ist. In der Begründung von Seiten des Lehrstuhls heißt es, dass man bei der Korrektur der Prüfungsleistungen ca. 66 Täuschungsversuche (stand 19.03.21) nachweisen könnte. Hauptsächlich seien Lösungsdateien, welche man im PDF-Format hochladen sollte, unter Studierenden während der Prüfungszeit geteilt worden, weshalb beim Lehrstuhl identische Dateien eingereicht wurden. Des Weiteren erklärt der Lehrstuhl, dass Ergebnisse bei den Theorieaufgaben den Rückschluss zulassen, dass die Lösungen dieses Teils im Vorfeld bekannt waren. Dies soll laut dem Lehrstuhl passiert sein, durch Verwendung identischer Fragen aus Klausuren der letzten Jahre und dadurch das ehemalige Klausurteilnehmende die Möglichkeiten bei Klausureinsichten genutzt haben die Fragen zu speichern. Diese beiden Argumente würden so laut dem Lehrstuhl eine Verletzung der Chancengleichheit darstellen, weil ehrliche Klausurteilnehmende gegenüber den unentdeckten Täuschenden benachteiligt werden würden.
Als Lösung für eine zukünftige Gewährleistung der Chancengleichheit beantragte der Lehrstuhl die Annullierung der Klausur aller Klausurteilnehmer, wobei allerdings nur die Täuschenden den Versuch als Fehlversuch behalten sollen. Des Weiteren müssen nun alle Prüfungsteilnehmenden, welche die Prüfungsleistung erbringen müssen, die Klausur in Form einer Präsenzklausur im Open-Book-Format in Frankfurt (Oder) an der Europa-Universität am 07.04.2021 bis 09.04.2021 (zum Ersttermin) und Mitte Mai (zum Zweittermin) ablegen.
Am 15.03.2021 wurde ein ca. zweistündiges Onlinemeeting mit dem verantwortlichen Lehrstuhlinhaber, der Vorsitzenden des Prüfungsausschusses und den Klausurteilnehmenden veranstaltet. Viele Studierende haben ihren Unmut über die Lösung des Prüfungsausschusses erklärt. Befürwortung für die Lösung von Seiten der Prüfungsteilnehmenden gab es in der ganzen Sitzung kaum.
Die Argumente der Prüfungsteilnehmenden, welche die Lösung ablehnen sind:
1. In der Konsequenz liegt eine Generalbestrafung vor. Der Lehrstuhl möchte seine Lösung nicht als Bestrafung verstanden wissen, sondern als Gewährleistung der Chancengleichheit. Dies ist für viele Klausurteilnehmende, welche ihre Prüfungsleistung ehrlich erbracht haben, aber inakzeptabel, da folglich das Fehlverhalten einiger auf Kosten aller sanktioniert wird.
2. Jede Prüfung ist mit viel psychischen Aufwand und Energie verbunden. Viele Studierende empfinden Prüfungssituationen als sehr stressig. Man sollte deshalb Studierenden keine Extraprüfungsleistung abfordern, wenn eine ehrlich erbrachte Prüfungsleistung vorliegt.
3. Im Gegensatz zur Darstellung des Lehrstuhls ist Chancengleichheit zum derzeitigen Stand nicht gewährleistet. Die Note für die jetzige Klausur soll, zum aktuellen Stand (15.03.21), allen Prüfungsteilnehmenden nicht mitgeteilt werden. Anscheinend sei dies aber schon geschehen. So berichteten einige Klausurteilnehmende, dass sie die Noten bekommen haben, bzw. dass sie sogar eine Klausureinsicht mit genauer Punktevergabe einsehen konnten. Der Lehrstuhl wies dieses Argument mit der Begründung zurück, dass es sich um Einzelfälle bzw. Systemfehler handelte. Für viele Studierende ändert dies aber nicht, dass somit schon die Chancengleichheit verletzt ist.
4. Unzumutbarkeit von Reisen und Nutzen öffentlicher Verkehrsmittel in Zeiten der andauernden COVID-19 Pandemie. Einige Studierende leben mit Familienmitgliedern zusammen, welche in einer Risikogruppe sind. Eine Durchführung in Präsenz setzt so die Klausurteilnehmenden und ihre Familienmitglieder in Gefahr.
5. Fehlende Beweislast und Unterstellungen. Die Entscheidung über die Annullierung der Prüfungsleistung basiert auf unzureichender Beweislast. Es wird vom Lehrstuhl wie folgt argumentiert: „Ferner lassen die Ergebnisse bei den Theorieaufgaben den Rückschluss zu, dass offenbar die Lösungen im Vorfeld bekannt waren oder ausgetauscht wurden.“ und „Ehrliche Teilnehmende werden gegenüber unentdeckten Täuschenden benachteiligt.“ Bisher konnte die Information, dass Lösungen im Vorfeld bekannt waren nicht bestätigt werden. Der Lehrstuhl kommt zu diesem Schluss, indem er argumentiert, dass in Theorieaufgaben, welche in den Vorjahren gestellt wurden, höhere Punktzahlen erreicht wurden als im neuen Theoriefragenteil. Darüber hinaus trifft der Lehrstuhl Aussagen wie „unentdeckten Täuschenden“ und „offenbar“ in Bezugnahme auf vermeintliche Täuschungen. Diese Formulierungen ohne konkrete Beweislast kann nur auf grober Unterstellung gegenüber allen Studierenden basieren. Deshalb widersprechen wir der Entscheidung des Prüfungsausschusses, dass § 22 ASPO Mängel im Prüfungsverfahren anzuwenden ist. In jetziger Form wird so das Potenzial zugelassen, dass ehrliche Klausurteilnehmende zu Unrecht der Täuschung beschuldigt und womöglich verurteilt werden. Dies widerspricht unserer Meinung nach der allgemein geltenden Unschuldsvermutung.
6. Ökologische Belastung. Eine Anfahrt nach Frankfurt (Oder) ist zwangsläufig mit CO2 Emission verbunden, welche sonst verhindert werden würde.
Diese sechs Punkte führen für viele Klausurteilnehmende zu dem Schluss, dass die Universität nicht in der Lage war Verfahren zu implementieren, womit angebliche Täuschungsversuche verhindert werden konnten. Dieses Versagen soll nun auf Kosten von Studierenden in Form einer allgemeinen Bestrafung korrigiert werden, welche ihre Prüfungsleistung ordnungsgemäß erbracht haben und dies, obwohl das Verfahren mit Täuschenden in §21 (1) S.1 ASPO eindeutig definiert ist.
Daraus resultiert unsere Forderung, dass die Annullierung aufgehoben werden soll. Das heißt die Normalsituation wird wiederhergestellt. Ehrliche Studierende bekommen ihre Note, nachgewiesene Täuschungsversuche zählen, mangelnde Prüfungsleistungen zählen ebenfalls. Die Bedingung, die wir daran knüpfen ist, dass nachgewiesen werden muss, wie es im Einzelfall zu einem Täuschungsversuch gekommen sein soll, indem man es dem Studierenden eindeutig nachweisen kann. Darüber hinaus, bleibt der Zweittermin am 26.03.2021 zur gleichen Uhrzeit im reinen Onlineformat weiter bestehen. Zur Verhinderung von Täuschung setzt dies der Lehrstuhl in Form eines komplett neuen Theorieteils und randomisierten Anwendungsaufgaben durch. Zusätzlich können Studierende ihre Identität beweisen in dem sie freiwillig ihre Kamera und Mikrophon aktivieren.
Somit würde gewährleistet werden, dass ehrliche Prüfungsteilnehmende ihr Studium geordnet fortführen können, Klausurteilnehmende, bei welchen die Prüfungsleistung nicht reichte, die Chancengleichheit und Identität der Prüfungsbedingung abgesichert und zudem das Verhalten derjenigen Studierenden, welche nachweislich getäuscht haben, sanktioniert wird.
Ziel dieser Petition ist es dem Prüfungsausschuss, der Präsidentin und dem Lehrstuhl die Ablehnung der jetzigen Lösung zu zeigen und gleichzeitig eine Lösung zu präsentieren, welche sowohl zumutbar ist als auch die Prüfungsstandards gewährleistet. Es ist unser Ziel als Studierende eine gemeinsame Lösung mit dem Prüfungsausschuss, der Präsidentin und dem Lehrstuhl zu finden, da wir der Meinung sind, dass eine gemeinsame Lösung für das langfristige Verhältnis zwischen Studierenden und Lehrenden produktiver ist.

Students of the IBWL, IBA, and Economics and Law and Economics degree program took an exam on February 26th, 2021 in the module Business Informatics, which is part of the basic studies, which is mandatory in all study programs. The examination conditions of the exam were a pure online implementation in open-book format, provided that the communication of the students with each other during the exam is strictly prohibited. The test consisted of an application part (60% of the grade) and a theoretical part in the form of yes/no questions (40% of the grade). This examination was canceled by the Examination Committee on March 3rd, 2021 at the request of the professor responsible. It should be noted that the professor responsible is also part of the Examination Committee.
The explanatory statement on the part of the professor responsible states that while correcting the examination performance, that about 50 attempts at deception (as of 15.03.21) could be proven. According to the professor responsible mainly, solution files, which should be uploaded in PDF format, were shared among students during the examination period, which is why identical files were submitted to the professor responsible. Furthermore, the professor responsible explains that results in the theoretical assessment allow the conclusion that the solutions of this part were known in advance. According to the chair, this is supposed to have happened, by using identical questions from exams in recent years and thus former participants in the exam saved the questions during exam reviews. According to the professor responsible, these two arguments would constitute a violation of equal opportunities, because honest students would be disadvantaged against the undiscovered deceiver.
As a solution for a future guarantee of equal opportunities, the chair requested the cancellation of the examination for all students to the Examination Committee. Only the deceivers should keep the attempt as a failed attempt. Furthermore, all participants who have to pass the examination because it is part of their basic studies must now complete the exam in the form of an exam presence in an open book format in Frankfurt (Oder) at the European-University from April 7th, 2021 to April 9th, 2021 (at the first date) and mid-May (at the second date).
On March 15, 2021, an online meeting with the professor responsible, the chairman of the examination committee, and the exam participants was held. Many students have expressed their displeasure at the Examination Committee’s solution. There was little support for the solution on the part of the examiners throughout the session.
The arguments of the examiners who reject the solution are:
1. As a consequence, there is a general punishment. The professor responsible does not want its solution to be understood as punishment but as a guarantee of equal opportunities. This is unacceptable for many exam participants who have performed their exams honestly, as the misbehavior of some is sanctioned at the expense of all.
2. Each test involves a lot of mental effort and energy. Many students find exam situations very stressful. Students should therefore not be asked for an extra examination if they have submitted an honest examination.
3. In contrast to the statement of the professor responsible, equal opportunities are not guaranteed at present. The grade for the current exam is not to be published to all participants at the moment (March 16th, 2021). However, this has apparently already happened. For example, some of the participants reported that they had received their grades, or that they could even see a detailed exam review online with precise points. The chair rejected this argument on the grounds that these were isolated cases or system errors. For many students, however, this does not change the fact that equal opportunities are already violated.
4. Unreasonable travel and use of public transport in times of the ongoing COVID-19 pandemic. Some students live with family members who are in risk groups. Therefore, an implementation of the exam in presence puts the participants and their family members at risk.
5. Lack of burden of proof and insinuations. The decision to cancel the examination is based on an insufficient burden of proof. It is argued by the professor responsible as follows: "Furthermore, the results of the theoretical assignment allow the conclusion to be drawn that the solutions were known in advance or exchanged" and "Honest participants are disadvantaged against the undiscovered deceiver." So far, the information that solutions were known in advance could not be confirmed. The professor responsible comes to this conclusion by arguing that higher scores were achieved in theoretical assignments which were also part of exams in previous years than in the new theory assignment. In addition, the professor responsible makes statements such as "undiscovered deceiver" and "obvious" in reference to presumed deceptions. These statements without a particular burden of proof can only be based on a gross insinuation to all students. Therefore, we disagree with the decision of the Examination Committee that Section 22 ASPO of defects in the examination procedure is to be applied. As a result of the decision made by the Examination Committee, there is a potential that allows honest exam participants to be wrongly accused of deception and possibly condemned. In our opinion, this contradicts the generally accepted presumption of innocence.
6. Ecological pollution. A journey to Frankfurt (Oder) is necessarily associated with CO2 emissions, which would otherwise be prevented.
These six points lead many students to conclude that the University was not able to implement procedures, which could prevent alleged attempts at deception. This failure is now to be corrected in form of a general punishment at the expense of students who have orderly performed their examination even though the procedure with deceivers is clearly defined in Section 21 (1) S.1 ASPO.
This leads to our demand that the cancellation should be lifted. Therefore the normal situation is restored. Honest students shall get their grade, proven attempts of deception shall count, lack of exam performance shall count as well. The condition that we attach to this is that it must be proven how an attempt of deception in individual cases has been made by being able to prove it unequivocally to the student. In addition, the second date March 26th, 2021 will remain in the same online format at the same time. To prevent deception, the professor responsible enforces this in the form of a completely new theoretical assignment and randomized application assignment. In addition, students that want to prove their identity can do so, by activating the camera and the microphone of their computers in the exam.
This would ensure that honest participants can continue their studies in an orderly manner, that the examination participants, for whom the examination performance was not sufficient, have guaranteed the equal opportunities and identity of the examination conditions, and that the behavior of those students who have verifiably deceived is also sanctioned.
The aim of this petition is to show the Examination Committee, the President, and the professor responsible the rejection of the current solution and, at the same time, to present a solution that is both reasonable and guarantees the standards of examination. As students, our goal is to find a common solution with the Examination Committee, the President, and the professor responsible, as we believe that a common solution for the long-term relationship between students and professors is more productive.

According to the chair, this is supposed to have happened, by using identical questions from exams in recent years and thus former participants in the exam saved the questions during exam reviews. According to the professor responsible, these two arguments would constitute a violation of equal opportunities, because honest students would be disadvantaged against the undiscovered deceiver.
As a solution for a future guarantee of equal opportunities, the chair requested the cancellation of the examination for all students to the Examination Committee. Only the deceivers should keep the attempt as a failed attempt. Furthermore, all participants who have to pass the examination because it is part of their basic studies must now complete the exam in the form of an exam presence in an open book format in Frankfurt (Oder) at the European-University from April 7th, 2021 to April 9th, 2021 (at the first date) and mid-May (at the second date).
On March 15, 2021, an online meeting with the professor responsible, the chairman of the examination committee, and the exam participants was held. Many students have expressed their displeasure at the Examination Committee’s solution. There was little support for the solution on the part of the examiners throughout the session.
The arguments of the examiners who reject the solution are:
1. As a consequence, there is a general punishment. The professor responsible does not want its solution to be understood as punishment but as a guarantee of equal opportunities. This is unacceptable for many exam participants who have performed their exams honestly, as the misbehavior of some is sanctioned at the expense of all.
2. Each test involves a lot of mental effort and energy. Many students find exam situations very stressful. Students should therefore not be asked for an extra examination if they have submitted an honest examination.
3. In contrast to the statement of the professor responsible, equal opportunities are not guaranteed at present. The grade for the current exam is not to be published to all participants at the moment (March 16th, 2021). However, this has apparently already happened. For example, some of the participants reported that they had received their grades, or that they could even see a detailed exam review online with precise points. The chair rejected this argument on the grounds that these were isolated cases or system errors. For many students, however, this does not change the fact that equal opportunities are already violated.
4. Unreasonable travel and use of public transport in times of the ongoing COVID-19 pandemic. Some students live with family members who are in risk groups. Therefore, an implementation of the exam in presence puts the participants and their family members at risk.
5. Lack of burden of proof and insinuations. The decision to cancel the examination is based on an insufficient burden of proof. It is argued by the professor responsible as follows: "Furthermore, the results of the theoretical assignment allow the conclusion to be drawn that the solutions were known in advance or exchanged" and "Honest participants are disadvantaged against the undiscovered deceiver." So far, the information that solutions were known in advance could not be confirmed. The professor responsible comes to this conclusion by arguing that higher scores were achieved in theoretical assignments which were also part of exams in previous years than in the new theory assignment. In addition, the professor responsible makes statements such as "undiscovered deceiver" and "obvious" in reference to presumed deceptions. These statements without a particular burden of proof can only be based on a gross insinuation to all students. Therefore, we disagree with the decision of the Examination Committee that Section 22 ASPO of defects in the examination procedure is to be applied. As a result of the decision made by the Examination Committee, there is a potential that allows honest exam participants to be wrongly accused of deception and possibly condemned. In our opinion, this contradicts the generally accepted presumption of innocence.
6. Ecological pollution. A journey to Frankfurt (Oder) is necessarily associated with CO2 emissions, which would otherwise be prevented.
These six points lead many students to conclude that the University was not able to implement procedures, which could prevent alleged attempts at deception. This failure is now to be corrected in form of a general punishment at the expense of students who have orderly performed their examination even though the procedure with deceivers is clearly defined in Section 21 (1) S.1 ASPO.
This leads to our demand that the cancellation should be lifted. Therefore the normal situation is restored. Honest students shall get their grade, proven attempts of deception shall count, lack of exam performance shall count as well. The condition that we attach to this is that it must be proven how an attempt of deception in individual cases has been made by being able to prove it unequivocally to the student. In addition, the second date March 26th, 2021 will remain in the same online format at the same time. To prevent deception, the professor responsible enforces this in the form of a completely new theoretical assignment and randomized application assignment. In addition, students that want to prove their identity can do so, by activating the camera and the microphone of their computers in the exam.
This would ensure that honest participants can continue their studies in an orderly manner, that the examination participants, for whom the examination performance was not sufficient, have guaranteed the equal opportunities and identity of the examination conditions, and that the behavior of those students who have verifiably deceived is also sanctioned.
The aim of this petition is to show the Examination Committee, the President, and the professor responsible the rejection of the current solution and, at the same time, to present a solution that is both reasonable and guarantees the standards of examination. As students, our goal is to find a common solution with the Examination Committee, the President, and the professor responsible, as we believe that a common solution for the long-term relationship between students and professors is more productive.
