We, the Apartment Owners and Vatika Residents at Vatika City, Sec 49, Gurugram, Haryana 122018,  demand immediate resignation of corrupt Vatika City RWA (Vatika City Apartment Owners Association) office bearers.
They have started believing that they can get away with just anything under the sun and have clearly been taking the residents for a ride, not even stopping at stealing from their pre-paid meters.
We the residents have NO confidence in the current RWA (VCAOA) due to numerous acts of fraud, cheating, falsifications, non-transparency, bad behavior, incompetence and thieving. WE DEMAND THAT THEY RESIGN IMMEDIATELY.

The reasons for our demand are on account of the following:

1. Act Of cheating & impersonation by The RWA President - RWA President Mr Giriraj Gupta was exposed by Police Cyber Cell Gurugram): Mr President was pulled up by Cyber Cell, Gurugram for shameful acts of cheating & impersonation. He created fake email IDs and used them to threaten & malign residents who did not support the RWA's unilateral dictatorial decisions. These residents who questioned his various decisions, acts and malpractices as President, RWA were subjected to derogatory language and threats. Mr. Gupta accepted his crime & submitted a written apology to the residents who he had been maligning & defaming using this unscrupulous approach.
2. Proven Misappropriation of funds: The District Registrar ordered an enquiry against VCAOA after several aggrieved residents complained to Registrar General of Societies Haryana (RGSH) of mismanagement, incompetency, falsification of facts & documents and misappropriation of funds by VCAOA. 
   The inquiry was conducted by Mr. Anurag Gehlawat, Joint Director of Industrial Safety & Health (NCR). He confirmed the definitive role of Giriraj Gupta (VCAOA President), Anil Malhotra (VCAOA General Secretary) and Mahender Kumar (VCAOA Treasurer)  in 8 counts of irregularities, mismanagement of the society and misappropriation of funds.
   The report was submitted to the District Registrar who ordered strict action against the above mentioned. Post this, Mahender Kumar resigned from his position as the Treasurer.
   THEY WERE PROVEN GUILTY.

   To top this, they used the residents hard earned money to get a stay on the same.
3. Harassment of children: On the pretext of preserving the horticulture, this RWA who had won the elections on the back of a promise of creating better recreational sports facilities for residents, has been putting up guards to prevent kids from entering the parks.
   Vatika boasts of a wonderful community culture because of its healthy living residents and wonderful sports camaraderie. This RWA is hell bent on destroying it.
   They have even gone ahead to put up expensive boards with signs of NO PLAYING at all Vatika parks to prevent children from playing. The residents fervently went against the boards but they have not removed them and continue to prevent playing in the parks, much against the existing order from High Court.

4. Massive Operational Losses Leading To Additional Financial Burden On Residents During COVID Time - INR 1.69 Cr losses incurred due to incompetency, lack of effective planning, knowledge and misappropriation of funds.  Incompetent handling of RWA office has led to operational losses of INR 1.69 Crores.
   Mr Anil Malhotra, in a meeting with Vatika Senior Citizen Association informed that they have paid 1.69 Cr on account of GST to various vendors against their invoices. This has built up a massive GST input credit which cannot be now recovered.
   Noteworthy is the fact that this was building up each month and nobody amongst the RWA elite noticed or took corrective course. They also have a CA consultant who is paid INR 4 Lacs per annum who didn't notice this or consult them to correct course.
   Post this they connivingly tried to recover these losses from residents by mis-representing them as "GST arrears" towards 1057 flats who were out of the GST remit as their CAM was less than INR 7500.
   They could've saved these losses in multiple ways had they acted in time, had right intent and capabilities, but their incompetency got the better of them.
5. Day Light Robbery Of Residents: Stealing money from pre-paid resident meters to fund the losses without asking for residents permission. 
   He tried to recover these losses from Vatika residents under the garb of GST arrears until his cover was broken by Amit Goel, Vipul Sharma and a few other senior residents of the society. This at the time of COVID when for a few senior members of the society, their bread earners had lost jobs too.
   The collection was FORCED from all residents within a period that suited them even after repeated requests from senior members to spread it across a longer period as it will cause financial strain to them.
   Most others paid to avoid what Mr Anil Malhotra termed "A threat to Vatika's existence, to the extent of discontinuation of basic facilities & services by requisite authorities."
6. Bad Management leading to degradation of facilities and atrocious service levels:
   - RWA is being run by only 4 office bearers, the rest have resigned over the period over disagreements and other reasons
   - These handful office bearers have made the society their fiefdom and are "ruling" it with an iron fist (dictatorial ways)
   - No General Body Meetings (GBM) have been conducted in the past 3 years even after repeated requests by Apartments Owners and residents
   - CAM charges are up
   - The level of security and number of guards has gone down
   - The service levels are have deteriorated beyond compare
   - Resident ire at depleting levels are at an all time high
   - There is zero transparency on financial & operational decisions
   - Rules are implemented at whims & fancy and forced upon the residents
   - All their forums are one way communications wherein none of the residents have rights to feedback on services or bring up RWA fallacies.
7. Massive financial implications for the residents (on account of 4, 5 & 6): 
   - Residents were misguided by their claims of reducing CAM charges. Now they are having to pay for high CAM, 1.69 Cr of losses incurred due to incompetency and will not be exempt from GST either because everyone will be above INR 7500 in CAM charges.
   - Residents end up paying for all their court fees incurred on account of residents filing complaints and cases against them
   - Residents end up paying for all the fund misappropriations done by RWA
   - Residents are publicly named and shamed
8. Misrepresentation of facts and defamation of respectable society residents who stand against their dictatorial, corrupt and thieving ways. 
   Giriraj Gupta and Anil Malhotra continue to defame all the residents who stand against their atrocities.

As of today, owners & residents stand together on multiple social media forums and through this petition we ask for an immediate GBM and resignation of all VCAOA (RWA) office bearers.
