

India Need Unified Civil Code
The Issue
Dear Prime Minister Sir ,
We welcome the steps taken by the govt of India for a Uniform Civil Code in India. It is only the UCC that is in consonance with our constitution and its spirit. One law for all is indispensable in a modern secular democratic nation state for ensuring and upholding natural justice and human rights. It is only UCC that can guarantee equality to all irrespective of caste, religion or sex.
First of all Article 14 of the constitution of India provides for Equality before the law. Then how come Hindu and Muslim women in India are unequal before the law? How was this practice of personal laws allowed to continue in independent India. It was a result of Nehru's appeasement politics that he allowed UCC to continue in India. Article 14 is the most paramount of all fundamental rights. So beyond it we did not even need a reference in the constitution for a Uniform Civil Code. However the constitution of India further goes on to clearly direct govt to ensure a Uniform Civil Code in Article 44.What more do we need ?
Ah I have been hearing a lot about Article 25 from many people and self proclaimed intellectuals as a defence to personal laws. Article 25 allows us to practise our religion and religious rituals. It doesn't and can't allow us to discriminate on the basis of religion. We can't allow religion to become a basis for discrimination. India is not a theocracy. UCC doesn't take away your right to practise your religion. It just ensures equality before the law, the most fundamental of all fundamental rights. And Shari'a can not become the basis of law in 21st century secular democracies. When there is a uniform Indian Penal Code for criminal laws, why should not there be a uniform civil code for civil laws in India ? Therefore I urge you Modi ji to go ahead and implement UCC. The nation stands with you. Initiate a dialogue with those who oppose UCC. It is fine if they agree. And if they don't, govt of India and its legislations can't be held to ransom by a bunch of Mullahs of Muslim Personal Law Board. Go ahead with UCC. We are with you. Those who oppose will either fall in line or be made to fall in line by law. Reforms have always been opposed by orthodox fundamental sections of society. They will always be. It is a sham if regressive practices like Triple Talaq and polygamy are allowed to continue in India.
This is our democracy, the republic of India. This is not a theocracy. Period.
