The issue
This is the story of Alexander and Suping, so far. My son, Alexander Miziner, is an Australian citizen. His fiancé Xu Suping is a Hong Kong resident. They have been in a long distance relationship for more than two and a half years. During this time Alexander had visited Suping in Hong Kong and China, six times, totalling over six month of actual time together, with each other, personally. Further, they communicate with each other several times every day via Internet and phone. They applied for subclass 300 visa (intended marriage visa) in June 2014. However their application was rejected by the Immigration Department. Furthermore that decision was upheld by Administrative Appeals Tribunal! They said: “the Tribunal is not satisfied that the visa applicant genuinely intends to live together with the review applicant as spouses” and, “The Tribunal is not satisfied that the inception and the development of the relationship between the visa applicant and the review applicant are true”. Basically, despite the huge volume of evidence presented, the Tribunal is saying, that the love they have shared over the past two and a half years is not genuine. Therefore, they are liars, and so are their family and friends, who testified that they are very genuine. Now all their plans for their future happiness are trashed!
I am an eighty year old woman, and my fifty five year old son, is my sole carer. It is a full time job for him. He came to Australia more than ten years ago, to look after my husband and me. My husband passed away last year, and Alex is the only person right now to look after me - he is my carer, my helper, my support in every way. For the last ten years, since he took this responsibility, he has lived alone. When he finally met Suping, who he feels is his soulmate, I was very happy! I personally witnessed their communications via WeChat, multiple times every day! I see how his face lights up, when he talks to her! When I hear how she talks to him, I have no doubt in my mind that these two are in love. They have been engaged for almost a year now! Suping’s daughter is now studying in the University of NSW, and lives in his apartment, full time, as they all feel they are a family, even though Suping still lives overseas. I am absolutely certain, that they wish for nothing more, than to spend the rest of their lives together! My dream is to be present at my son’s wedding and see him happy before I am gone! Right now the Ministerial decision is our last hope! If we don’t get a positive outcome, the only option my son will be left with, is to move to Hong Kong to get married. Then, they would have to start a new application with Department of Immigration from scratch, and remain there, while it is processed. This could take at least two more years, and I might not have this sort of time left! It pains me to see, how my son is suffering! His heart is torn in half! He is facing an impossible decision - to leave his mother, who he loves unconditionally or to deny himself the opportunity to be together, with the woman he loves! No civilized society should put its members in such a position! It is an unbearable choice to make! As an Australian Citizen, my son has an undisputed right to happiness, to love and to marry whoever he chooses, providing that person is not a criminal, and Suping is not a criminal. Her clean criminal records, that a part of her application for intended marriage visa is proof of this!
