Urgent takeover of State Health Facility of Bihar to save 1000s of lives - appeal!

The Issue

I pray for your support as your simple signature can get the nation moving to save thousands of lives in Bihar.

I am personally feeling helpless and grieved about the people of Bihar who are currently going through one of the most perilous times in their recent history. Not only are COVID-19 cases rising by the thousands everyday but the number of deaths is also staggering. I am personally aware that infected patients are not even getting hospital beds and suffering on streets and pavements outside hospitals. Furthermore the state is suffering from one of the worst floods which has impacted over 500,000 lives already during this time of pandemic crisis. Having taught students in Bihar and returned from its capital only a few days prior to the national lockdown in India, I am praying for your support.

If Bihar were a country, it would receive international aid by now given the wide spread agony and suffering of its people. I pray that the center takes over the State Health Facility of Bihar and save the thousands of innocent lives which now hang only on a very thin string. I urge the Hon`ble Prime Minister of India, the Hon`ble Chief Justice of India, and the Hon`ble President of India to take action immediately.

I am also aware that Mr. Aditya Jalan, a bonafide resident of Quila House, Patna City has filed a Public Interest Litigation under Article 32 against the Union of India and State Government of Bihar before the Hon`ble Supreme Court on 28 July 2020. The Public Interest Litigation has been moved on "most urgent" basis by Mr. Aditya Jalan seeing the depreciating and disturbing conditions of public health infrastructure in the State of Bihar. This petition highlights the failure of the State Government of Bihar in being able to manage the spread and treatment of Covid - 19 virus and calls for Union Government intervention to save lives as a matter of urgency. The petition also speaks about the abysmally low testing of Coronavirus being done by Bihar Government as compared to other State Governments of India. Mr. Jalan by way of this petition has highlighted the casual attitude of the State of Bihar in making adequate advance arrangements in the public health system of the State to tackle the Covid - 19 crisis.

The petition also highlights the problems caused by the recent floods coupled with the Covid –19 crisis which is causing large scale destruction and loss of lives across the State of Bihar. Mr. Jalan has prayed from the Hon`ble Supreme Court to direct the Union of India to exercise its powers under Article 355 of the Constitution of India and Section 62 of the National Disaster Management Act, 2005 and take over the public health machinery of the State of Bihar. In the alternative, the Petitioner has prayed from the Supreme Court to direct the Union of India to assist the State Government in managing the Covid –19 crisis. The petition has been filed by Mr. Jalan through his advocates i.e. Advocate Roshan Santhalia (Advocate on Record, Supreme Court) and Advocate Nikitha Surabhi.
