"Death Penalty for the Juvenile" - Nirbhaya Gang Rape Case
The Issue
It is about our India's daughter Nirbhaya (Jyoti Singh). By now whole world is aware of the tragic incident happened on 16th December 2012. Court declared it 'Rarest of Rare cases'. "Women who go out at night have only themselves to blame in case they attract attention of male molesters," said by Mukesh Singh, driver of the bus. The documentary recently released which has been successfully banned by our 'court of justice' clearly depicts the mentality of the accused, they are not ashamed rather as per him it is "an accident", they were trying to correct the society by punishing 'nirbhaya'.
Really?? I want to ask who are you all "Mukesh Singh, Ram Singh, Pawan Gupta, Vinay Sharma, Akshay Thakur and the Juvenile, you people are not human's for sure. And yes Mukesh you are no one to teach anyone any lesson. Now the question comes in my mind is liberal juvenile law in India, which does not permit detention beyond three years irrespective of the gravity of the crime.
According to the documentary I'm not allowed to watch a movie at night time, if i do so I'm inviting these monsters to rape me. They are right if they do so because it is human right to enjoy, either they do it by power of their money or by their courage. So all these accused choose'd the second option which is courage.
The most brutal out of all the accused's was the juvenile, most surprising is that he is the one who has got least punishment out of all "just three years". Now the question which comes in my mind is why he cannot be treated as adult, at the time of the incident he was a few months short of 18 years, has been held guilty of taking part in the gang rape, assault and murder. Can these few months change his mentality towards women, if he was 18 will he not support the rape. What would have been changed??
And the answer is nothing.
What was her fault she had dreams, she wants to help her parents?? She did so much of hard work, compromised all her enjoyment just to make her career, at the end when she was about to get everything, these monsters brutally raped her, forced her to death. If only three years is the punishment for a juvenile then all the crimes should take place before attaining 18 years of age. Why our law cannot treat a juvenile as an adult in heinous crimes like this. If the amendment to the Juvenile Justice Act is approved, it will at least create a sense of fear in such juveniles and help bring down crimes by 50 percent.
Can our Juvenile Justice Board guarantee's that correction home has taken down monster out of him, will he not rape again?? He will roam on the road's free, but will all the women's will feel safe after his release. It will give him more courage and power to do it again.
All I demand through this petition is death penalty for the juvenile who is going to be free in December this year, amendment in the Juvenile Justice Act, 2000; treatment of juvenile as adult in 'rarest of rare cases'. It will bring the hopes of the criminals down and will set an example for all who are going or willing to go on his path.
