JAMAICANS UNITED AGAINST DOMESTIC VIOLENCE AND CHILD ABUSE IS SEEKING LEGISLATIVE REFORM OF THE JAMAICA GOVERNMENT'S "SEXUAL OFFENCE'S ACT, 2009," TO STOP THE SCOURGE ON CHILDREN AND IMPOSE STIFFER PENALTIES ON OFFENDERS, BY RAISING THE AGE OF CONSENT TO SEX, FROM AGE 16 FOR MINORS, TO CONFORM WITH JAMAICA'S "LAW OF REFORM (AGE OF MAJORITY) 1979 ACT" AGE 18.
As the current "Sex Offences 2009" law stands it neglects its duty to protect those in the GAP age group of 16-18 while at the same time it:
A) Denies them the right to vote.
B) Takes advantage of their lack of agency - unable to make decisions regarding legislation that will affect their life choices and ultimately their futures.
C) Is complicit with adult sexual predators,for the purpose of human trafficking and prostitution as a lifestyle.
D) Facilitates prostitution as a lifestyle. Promotes teenage pregnancy and the vicious cycle of under education, poverty, and abuse predominantly on the marginalized at risk group of children, without the benefit of abortion rights.
E) Promotes the spread of HIV/AIDS as as a result of sexual relations with HIV-infected older men and or forced sex.
F) Promotes early dysfunctional relationships leading to domestic violence and abuse oftentimes leading to death.
We of Jamaicans United against Domestic Violence and Child Abuse, believe it is high time Jamaica revisited this glaring disparity in its law re: the age of consent vs. (AGE OF MAJORITY) 18. It is Jamaica's responsibility to protect its most vulnerable underage citizens as per the UN Convention "Rights of a Child Act,' from this scourge against them. We therefore demand a revisit and reformation of the 'Sexual Offences Act, 2009" which serves to protect no one but the predators who prey on the youth.
THE JAMAICA'S "LAW OF REFORM (AGE OF MAJORITY) 1979 ACT" states in Paragraph 3: As from the appointed day a person shall attain the age of majority and be of full age and capacity ON attaining the age OF eighteen years instead of on attaining the age of twenty-one years, and any PERSON who, on the appointed day, is over the age of eighteen years but under the age of twenty-one years, shall be deemed to have attained the age of majority and be of full age and capacity on that day.
UN Convention Rights of a Child General Assembly Resolution 44/25 of 20 November 1989 entry into force 2 September 1990, in accordance with article 49, under which Jamaica is governed as a state party thereto, where it clearly states: Part 1 Article 1: For the purposes of the present Convention, a child means every human being below the age of eighteen years unless under the law applicable to the child, majority is attained earlier. Article 19: States parties shall take all appropriate legislative, administrative, social and educational measures to protect the child from all forms of physical or mental violence, injury or abuse, neglect or negligent treatments, maltreatment or exploitation, including sexual abuse, while in the care of parents(s), legal guardian (s) or any other person who has the care of the child. Such protective measures should, as appropriate, include effective procedures for the establishment of social programmes to provide necessary support for the child and for those who have the care of the child, as well as for other forms of prevention and for identification, reporting, referral, investigation, treatment and follow-up of instances of child maltreatment described heretofore, and, as appropriate, for judicial involvement.
