PETITION AGAINST THE WITHDRAWAL OF CORRUPTION CHARGES AGAINST LIN YUN HUA

We, the undersigned citizens of Malawi and supporters of wildlife conservation, good governance, and the rule of law, express our deep concern regarding reports that corruption charges against Lin Yun Hua may be withdrawn.

Any decision to discontinue these proceedings would send a troubling message about Malawi's commitment to combating corruption, organized wildlife crime, and transnational criminal networks. It would also risk undermining years of progress made by government agencies, law enforcement officers, prosecutors, conservation organizations, and international partners in the fight against wildlife trafficking.

Lin Yun Hua, a Chinese national widely regarded as one of the most significant wildlife trafficking figures ever prosecuted in Malawi, was convicted and sentenced to 14 years' imprisonment for offences under the National Parks and Wildlife Act and the Financial Crimes Act. Although sentenced to 14 years, he has served only four years of that term after receiving a presidential pardon in 2025 as part of a group of 37 inmates. However, he remained in custody because he was required to answer separate corruption charges that are currently before the courts.

The reported intention to withdraw these corruption proceedings raises serious concerns about the consistency, integrity, and independence of the justice system. Such a move risks weakening public confidence in Malawi's institutions and could create the perception that individuals involved in serious organized crime can ultimately evade full accountability.

Wildlife crime is not a victimless offence. Across Africa, criminal syndicates continue to drive the illegal trade in wildlife and wildlife products, contributing to the decline of endangered species, damaging ecosystems, undermining rural livelihoods, and threatening national natural heritage. Malawi has earned international recognition for taking a strong stance against wildlife trafficking, and the successful prosecution of Lin Yun Hua was widely regarded as a landmark achievement in the global fight against wildlife crime.

Strong custodial sentences and consistent enforcement of the law are essential deterrents against organized wildlife crime. When individuals convicted of serious wildlife offences are perceived to avoid accountability, criminal networks are emboldened, deterrence is weakened, and efforts to reduce demand for illicit wildlife products such as ivory and rhino horn are undermined. The consequences extend far beyond a single case and affect conservation efforts throughout the region.

As citizens and stakeholders committed to justice and accountability, we believe that all individuals, regardless of nationality, influence, or status, should be subject to the same legal standards. Allegations of corruption are serious matters that deserve to be heard and determined through due legal process. Allowing these proceedings to continue is not a judgment of guilt; rather, it is a necessary affirmation that justice must be allowed to take its course without interference.

We therefore respectfully call upon the Government of Malawi, the Director of Public Prosecutions, and all relevant authorities to reconsider any proposal to withdraw the corruption charges against Lin Yun Hua and to ensure that the matter proceeds through the judicial process in a transparent and impartial manner.

By allowing the courts to determine the case on its merits, Malawi will reinforce its commitment to the rule of law, strengthen public confidence in state institutions, uphold its international conservation commitments, and demonstrate that corruption and wildlife crime will not be tolerated.

We urge all concerned citizens, conservationists, civil society organizations, development partners, and members of the international community to join us in calling for transparency, accountability, and equal application of justice.
