The Issue
Individual or joint homeowners invest to purchase a townhome or condominium in a community and become subject to the covenants, conditions and restrictions of the Association, plus the By-Laws and then the rules handbook. The covenants and everything else are written by the developer, declarant, to protect its interest. When the developer terminates his selling of the properties and control passes to the homeowners, invariably the so-called amendment to the ccr and other documents follows almost verbatim the originals.
The end effect is ownership but subject to sometimes onerous and unfair liens, fees, penalties and certainly loss of peaceful enjoyment of what the buyer thought would be their joy. Should you agree, sign the petition, ask your friends and neighbors to do so, and then follow up with calls to your representatives until change takes place.
