Dear Luana Kai Board Members:

The purpose of this petition is to request that the dumpster, which is in a parking space in front of C & D buildings, should be relocated to the designated and screened garbage and recycling area by the kayaks on S Kihei Rd.  

The dumpster is currently residing in a parking place, which is a common area, and not a designated disposal facility and this is non-conforming to Article V, page 22 of the bylaws, "No refuse, garbage or trash of any kind shall be thrown, placed or kept on any common elements of the Project outside of the disposal facilities provided for such purpose."

The dumpster is dirty and smelly and does not conform to the bylaw  as set forth in  Article IV, page 15, number 2 "Keep all common elements of the Project in a strictly clean and sanitary condition". 

The dumpster also reduces recycling, since there are no recycling bins next to the dumpster.
