Release SSG Robert Bales and SSG Calvin Gibbs from Military Prison

The Issue

1.  SSG Bales and SSG Gibbs were denied the rights that are served to support and defend.

2.  Jury wasn't  provided information which can be used to defend or exonerate SSG Bales and SSG Gibbs of guilt and which can result in a reduced charge or lesser sentence.

Military Prosecutors failed to share what they must by US Law "exculpatory evidence", and prevented juries from "mitigating factors" and "extenuating circumstances"

3.  SSG Bales was not afforded the presumption of Innocence.

Bodies were not examined, nor were autopsies conducted/forensics confirmed on the allegations. 

Military did not confirm those that were killed were enemy combatants.  

Military did not prove their case in a trial, they went straight to sentencing after the confession. 

Military flew in confirmed enemy combatants, with aliases, to testify against SSG Bales.

Military did not evaluate SSG Bales' mens rea (mindset)

Military did not disclose that the army administered mefloquine an anti-malaria drug with psychotic effects, but the military stopped administering the drug after SSG Bales' incident.

3.  Military prosecutors prevent, ignore, denied forensic evidence and brought enemy combatants into the US to testify against SSG Bales.

4.  SSG Gibbs testified in his own defense and denied planning, conspiring, or killing any non-combatants.

5.  A Soldier who did not testify at SSG Gibb's trial, later testified that he and SSG GIbbs lawfully engaged one of three that SSG Gibb's is convicted of murdering.

6.  SSG Gibbs was not present for two of the three murders. 

There is NO FORENSIC EVIDENCE to support the allegations, only testimony from junior enlisted Soldiers the Court referred to as "...drug users, liars, and murderers...who had both a motive to fabricate and the opportunity to collude."

7.  Prosecutors accept, without challenge, evidence provided by foreign governments and testimony by enemy combatants over that provided by our Warriors.

These enemy soldiers have harmed and killed many American troops.

8.  The War with Afghanistan is coming to an end.  American Troops are being brought home.  Foreign governments, even those with which we may be allied, and our enemies, have a vested interest in making false allegations.

9. Thousands of Taliban have been released from confinement due to peace agreements.  Most have returned to the battle field in support of the terrorist groups.  Our American Warriors still remain incarcerated and we request COMMUTATION of SENTENCE for BOTH AMERICAN WARRIORS !!
