There are hundreds of thousands of U.S. citizens eligible to file for adjustment of status of their undocumented spouses, children or parents. Most won't file because they would have to be separated from their loved ones sometimes for years due to the current waiver process. As you are aware, the current process requires that they leave the U.S. for consular processing. Leaving the U.S. immediately triggers a 3 - 10 year unlawful presence bar for which the undocumented immediate relative must apply for a waiver and wait for approval before being allowed to return to their family in the United States. Imagine being separated from your husband/wife, child or parents so long! Earlier this year, you proposed to change the waiver process to allow stateside processing of these waivers so that undocumented immediate relatives could stay with their families while waiting for it to be approved. Not only would this allow families to stay together and reduce their hardship, it would dramatically streamline the process for immigration officials. The rule change has been published, the public comment period is over. We're just waiting on you and your staff to make a decision. Please, President Obama, I urge you to direct Department of Homeland Security Secretary Janet Napolitano to implement the I-601 Provisional Waiver now. Our families can't wait!
