June 12, 2018 To: Members, New Canaan Town Council Subject: Recognition and restoration and protection and of the Ancient Burial Ground know as the “Maple Street Cemetery” and the drift way/right of way directly to said cemetery. Dear Sirs and Madams My name is William R. Van Loan, Jr. and I am a direct descendant of Ezra Benedict who founded the Maple Street cemetery in 1824 and is buried there with wife Hannah. Presently M2 Partners LLC is doing major construction in the western portion of the original maple Street Cemetery. This cemetery is by definition an Ancient Burial Ground and is subject to Connecticut General Statutes 19a-295, 19a-315 and191-315a (copies attached). These Statutes do not permit an LLC to be the owner of an ancient burial ground/cemetery. As of now the Drift way is blocked and has been made inaccessible by M2 Partners LLC. and thus denying access to the Cemetery. The drift way was also established in 1824 by Ezra Benedict in perpetuity. (see vol. 5 pages attached, 521, 522 and 523 of the N. C. L. R. from the files at the New Canaan Town Clerk’s Office) . How then can construction over this drift way be allowed? I strongly urge the members of the Town Council to review these statues as they apply to the Maple street cemetery and the Town of New Canaan involvement in this matter. I want the Cemetery to remain in its original 1824 plan and the construction on it ceased and it and the drift way restored. Sincerely William R. Van Loan, Jr.
