NOTICE OF INTENT TO SUE SENT TO THE CAYMAN ISLANDS GOVERNMENT

First, we want to thank all of the Caymanians and other supporters who have signed this petition to ensure job security for Caymanians into future generations.
As hundreds of supporters signed the petition and also requested more to sign, it was brought to our attention yesterday that government officials have allegedly been warning civil service against signing this petition.
If this is truly the case, we believe that this is possibly, at a minimum, intimidation, obstruction and conspiracy which is a criminal act according to the Penal Code (2013 Revision).
On Page 116 of the law, ANY GOVERNMENT OFFICIAL CAN BE CRIMINALLY PROSECUTED under Section 322(a) Other Conspiracies which states that “A person who conspires with another or others to PREVENT OR DEFEAT THE EXECUTION OR ENFORCEMENT OF ANY LAW OR REGULATION; or effect any lawful purpose by any unlawful means, COMMITS AN OFFENCE.”

This is a national security issue that is affecting thousands of unemployed and under-employed Caymanians, because if these non-Caymanians are given the lifetime right to employment, they are LEGALLY ABLE to change occupations which potentially puts EVERY CAYMANIAN’S job at risk through REDUNDANCY if they are willing to work for cheaper than the Caymanian!

There are unemployed Caymanians who are legally pursuing their employment rights against the government, who has created this debacle by refusing to enforce existing laws on illegal hiring practices that favour non-Caymanians and discriminate against Caymanians.
We have taken the first step to sue the government to stop doing this.
In the Constitution, our Bill of Rights gives us the ABSOLUTE RIGHT to sue government when they violate us.
Section 26(1) Enforcement of Rights and Freedoms state that “ANY PERSON MAY APPLY TO THE GRAND COURT TO CLAIM THAT GOVERNMENT HAS BREACHED OR THREATENED HIS OR HER RIGHTS AND FREEDOMS UNDER THE BILL OF RIGHTS and the Grand Court shall determine such an application fairly and within a reasonable time.”

Since government is making some of our Caymanians indigent and on welfare by generously granting non-Caymanians the lifetime rights to take our jobs and leave Caymanians unemployed and impoverished, doesn’t that make us eligible for Legal Aid to sue the government for breaching our employment rights? How does that work when one arm of government is suing the other arm of government to enforce Caymanian employment rights over non-Caymanians?
