Queensland Human Rights Commission - Case Update !

We wanted to share an important update with everyone who has supported us over the past few years.

In 2024 we made a formal complaint to the Queensland Human Rights Commission against Queensland Police under the Human Rights Act 2019 after our lawyers requested the human rights commissioner seek leave to appear at Luke’s inquest but he refused and no mention of the violations were ever heard in court.

The commission has only now just formally accepted these complaints. Following its assessment, the Commission has arranged a compulsory conciliation conference with QPS, which will take place on the 11th of August.

This is another significant step in our pursuit of truth and accountability for our son Luke !

Due to the Commission's confidentiality requirements, we can’t discuss the details of the conference or what is said during conciliation. The lack of transparency is concerning, we believe any violations by state agencies should be made public in our opinion.  We can tell you that QPS are represented by the same lawyer who is actively blocking us obtaining evidence through the QCAT process. We are still approaching this opportunity in good faith though.

Our goal is simple…

📌A genuinely independent review or investigation.

📌A public apology for the way our family has been treated throughout this process.

For nearly four years we have continued to seek answers that we believe every family deserves after the death of a loved one following police use of force. Whatever the outcome, we will continue to pursue justice for Luke through every lawful and appropriate avenue.

Australia lacks a federal Human Rights Act, making it the only liberal democracy in the world without one, leaving protection up to individual states. Currently, only QLD, Victoria, and the ACT have these protections in place. Our ongoing case is a critical benchmark. The ruling will demonstrate the real-world effectiveness of these acts to the states still waiting to establish them.
