The Issue
A quick summary
My right was violated by a police officer in Grand Prairie Texas but I am the one now paying the price for it. The Grand jury that reviewed the video evidence of the incident found me not guilty of the allegations of Aggravated assault Felony charges being levied against me so they posted a no-bill decision in my favor instead of allowing a legal proceeding that could result in a 2-year jail term as desired by the District Attorney office. Unfortunately, the law wouldn't allow a Grand jury to look into the other related charges like the one that is a lesser misdemeanor charges of resisting arrest (which never happened) and the Judge threw me into a probationary period of 1 year. Now that this is showing on my record, I have been unable to land a job that I can use to feed my family because this started showing on my record. My rights was violated by this police officer and the video evidence clearly shows it but they wouldn't release the video to me. I wrote several letters to the police records department in Grand Prairie where the incident took place but they still wouldn't release the video. They emailed me that they got an order from the DA's office not to release it to the public. I guess because they need to hide the human rights violation part so I cannot sue them.

The following is the full story of the incident in 2024:
I live in the state of Texas. On November 12, I had a traffic stop by a police officer who told me I did not put on my turn signal.
He asked for my license, went to his car, came back after a few minutes and told me that I have a warrant for my arrest for damage of property. I answered and said, I cannot remember any incident of such and he should tell me exactly where and when this happened because I also think this must be a mistaken identity. He went on in the conversation without providing the details I had asked for. As he was speaking, I asked if he is recording our conversation on his camera and he said yes, and I told him I would need to record with my phone to protect myself (My phone already in my hand). Immediately he flipped, said no and pulled my phone away from my hand.

*Please note that my reason for wanting to have a recording of my own is because I have seen a few social media videos that said Police can be sometimes careless with or even edit their camera evidence and it is better to have your own recording while conversing with them at traffic stops.

To continue the story - So while I was still sitting in my car and the officer was standing outside, I reached my hand to the phone which the officer had placed on top of my car, retrieve it and attempted to start my recording again because the officer had not ordered me to come out of the car yet.
As I retrieved the phone and before I could press start recording, the officer opened my car suddenly and jumped into the car to grab the phone from my hand. I stretched the phone to the other side of the car and he called for back up.
I have now been charged to court on the counts of Police assault, resisting arrest and Property damage (which they have not disclosed).
Subsequent update in February, 2025.
The police department emailed and let me know they had received an injunction from the state AG that allows them to block the release of the Police Cam evidence directly to me because it may interfere with their case in court. I read and understood from online articles that in such instances as above, the evidence can only be released to my attorney privately because they do not want public review and opinion. But unfortunately, I have personally refused to pay $7,000 to hire an attorney due to my financial situation.

Court rulings:
- Felony Charge for Assault of Police/peace officer
Grand jury(usually 12 undisclosed citizens) met in my absence as a usual court process to decide if the state should proceed with the case to trial because it is a serious charge. Grand Jury said No and this was ruled as a "No bill".
- Misdemeanor for Resisting arrest
Judge ruled, no jail term, all cleared after 12 months.
- Misdemeanor for property damage
Judge ruled, no jail term, all cleared after 12 months.
