The Issue
Petition to the Richmond County Board of Commissioners,
Amazon, Rockingham City Council, and Duke Energy
Whereas we, the undersigned residents of Richmond County, NC, oppose the siting and
operation of the Amazon data center and all additional data centers in Richmond County,
including those within municipal jurisdictions.
Whereas the Richmond County Board of Commissioners intentionally withheld
information from the public regarding the ownership, full scale, scope, and impact of the
proposed Amazon Data Center and its potential threat to public health, safety and welfare
prior to approval of the project, sale of land, and economic incentives to Amazon; and
Whereas Amazon withheld information from the Richmond County Board of
Commissioners regarding the full impact of the proposed Amazon Data Center and its
potential threat to public health, safety and welfare prior to contract with the Board of
Commissioners;
Whereas additional data centers are being considered across Richmond County,
including Rockingham;
Whereas Duke Energy is supporting the development of data centers;
Therefore, be it resolved, that the undersigned residents of Richmond County
request the following:
(1) that, based on the Richmond County Uniform Development Ordinance, the
Richmond County Board of Commissioners hold an evidentiary hearing to hear
public testimony and evidence related to the hazards created by the proposed
project that pose a serious threat to the public health, safety, and welfare of
Richmond County residents;
(2) that the evidentiary hearing be held in 60 days or more to provide time for parties
of interest to collect and document evidence of serious threat to the public health,
safety, and welfare to be presented at the hearing;
(3) that the Richmond County Board of Commissioners demand that Amazon cease
and desist from all construction activity at the site as is unlawful based on Section
165 of the Clean Air Act (42 U.S.C. § 7475(a)(1); 40 C.F.R. § 51.166(a)(7)(iii); 15A
N.C. Admin. Code 02D .0530(r)) until after the findings of the evidentiary hearing
are released, all permits are received, and all potential litigation is resolved.
(4) that the Richmond County Board of Commissioners, the City of Rockingham, and
all other municipalities considering data center development immediately approve
a one-year Moratorium on all proposals, rezoning, economic development
negotiations, and sales of land for the purpose of establishing a data center in
Richmond County in order to provide time to consider the full impact of data centers
on the quality of life for all residents and the county’s future.
(5) that Amazon immediately end all efforts to construct a data center in Richmond
County, NC due to the growing opposition to its data center as residents continue
to learn of its potential hazards and threats that were withheld from the public by
the Board of Commissioners and Amazon officials; and
(6) that Duke Energy immediately withdraw its support and partnership for and with
the Amazon Data Center in Richmond County and halt support for data centers in
all of its multi-state service areas due to the environmental, public health, and
energy burden and risks of data center development and operations.
