WHEREAS, you, the Santa Clara Valley Water District (SCVWD) Board Members, after publishing your promise to deliver clean water to Santa Clara Valley, have recently authorized so-called “fluoridating” (actually, poisoning) the water you collect and distribute with hexafluorosilicic acid, a highly contaminated industrial waste product, and thus you, the Board Members are personally legally responsible for all damages and deaths caused by this massive, deliberate, toxic water contamination, hexafluorosilicic acid and it’s heavy metal contaminants; and

WHEREAS, you, the SCVWD Board Members have authority to stop this action; and

WHEREAS, a) under the California Environmental Quality Act, (CEQA) law, the SCVWD must prepare an Environmental Impact Report of your intent to “fluoridate” the water, and this study must be completed before spending any District money or any other money provided to you to “fluoridate” the water, b) 99% of all “fluoride” added to the water goes into the environment, and c) this study is not even begun, clearly making the decision to “fluoridate” both overwhelmingly uninformed and patently illegal; and

WHEREAS, you are acting under the claim that “fluoridating” is good for children’s teeth, when in fact, you cannot produce even one single scientific, peer-reviewed, published study to show that there is any dental or other advantage to “fluoride” internal body exposure at all. Worldwide studies comparing fluoridated to unfluoridated communities show rates of carries going down dramatically across the board in all communities surveyed. When accounting for the finding that fluoride causes delay in emergence of teeth of about a year—which is alarming in and of itself--, thus providing less time that children’s teeth are vulnerable to cavities, the old claims used to begin this absurd toxic practice in the 50’s are even more absurd; and

WHEREAS, for those still convinced of a fluoride-treatment advantage, the state now covers the cost for fluoride topical treatment of all children’s teeth free of charge (California Health and Safety Code law sections 104830-104865), so mass water contamination makes even less sense. The chief advocate before your Board for water fluoridation, Dr Martin Fenstersheib, is in charge of the topical treatment program in Santa Clara County, which is a much less expensive, more targeted approach, but he has instead chosen to come to you and demanded this expensive, massive water contamination; and

WHEREAS, any individual or family, unaware of the hazards, who wishes exposure to fluoride on their teeth has simply to use fluoride toothpaste, usually less expensive and more readily available than non-fluoridated toothpaste. In today’s environment, children get fluoride exposure from toothpaste, antibiotics, pesticides applied to non-organic foods, food cooked on non-stick cooking surfaces, many beverages and packaged foods, fabric and carpet treatments; however, you have not measured, do not know, and, as a Board, have never even discussed the cumulative fluoride dose to which children and all people are currently exposed, their current fluoride body burden, or the degree of obvious damage fluoride exposure has already caused; but you intend nevertheless to add even more fluoride into the public water supply, a source whose effects most people could not escape; and

WHEREAS, fluoride exposures are already seriously damaging to at least 41% of U.S. children who exhibit the toxic effects of fluoridation, including white spotted; brown-stained; or brittle, broken teeth; and

WHEREAS, hexafluorosilicic acid, the form of “fluoride” to be used in our water, is a toxic waste product from the wet scrubbers of the fertilizer industry, and has never been required to undergo randomized clinical trials for safety or effectiveness by any regulatory agency in the world, and has been known to contain arsenic, cadmium, mercury, lead, hexavalent chromium, sulfates, radon, and uranium in addition to the toxic hexafluorosilicic acid. Deliberately adding these highly toxic substances signals the Board’s willingness to increase cancer rates to prevent cavities, clearly not acceptable or legal; and.

WHEREAS, hexafluorosilicic acid, the form of “fluoride” to be used in our water, is classified as hazardous waste too toxic for permitted disposal anywhere; and

WHEREAS, hexafluorosilicic acid added to water supplies prevents the emergence of deciduous teeth by as much as a year, causing even claimed benefit of incremental reduction of cavities to vanish; and

WHEREAS, “fluoridated” water provides an uncontrolled dose of hexafluorosilicic acid, a known toxin, to residents, some of whom may have to consume or be otherwise internally exposed to significantly large quantities due to: use of infant formula, particular occupation, outdoor activity, special diet, health conditions (such as diabetes mellitus and diabetes insipidus), medications being taken, or kidney dialysis; and

WHEREAS, hexafluorosilicic acid is the only substance added to public water for the purpose of treating and preventing disease (cavities), as opposed to treating the water itself to kill microorganisms. This toxic addition forces the entire population to participate in a wildly uncontrolled medical experiment. No residents have asked this Board for medical treatment, and it is illegal for this Board to act as a medical doctor to anyone or to treat anyone’s disease. Each resident’s medical condition is unknown to this Board. Mass medication even by a doctor is illegal. And any person or group acting as if they were doctors to randomly deliver a toxic substance to any unwilling person or even a willing person is committing a serious crime; and

WHEREAS, the very persons for whom this experiment is intended, young children, are especially vulnerable to the whole-body effects of “fluoride,” now known to adversely affect bone growth and development of all parts of the body: 50% of ingested “fluoride” is deposited in the bones of children making them brittle and subject to fracture, while only about 10% is stored in adults. The National Research Council in 2006 reported that American infants and young children are being exposed, on a body-weight basis, to 3-4 times the amount of fluoride as are adults, and young children’s bodies are especially susceptible to harm from chemical exposures due to their rapidly growing cells and tissues; and

WHEREAS, as recently as November 9, 2006 the American Dental Association (ADA) advised that parents of infants under 1 year of age use non-fluoridated water when mixing infant milk formula for their babies. It is patently unreasonable to expect uninformed, or low-income families to accomplish this when the source of water is deliberately contaminated. Cleaning fluoride-treated water is expensive and difficult to achieve with a filter, and even many affluent and informed parents will not be able to adequately protect babies who must be bottle fed; and

WHEREAS, consuming hexafluorosilicic acid in municipal water supplies, or in naturally highly fluoridated water has documented, peer-reviewed, scientifically published, significant, adverse health effects, including, for example:

a) Risk to the brain and intelligence shown by more than 23 human studies and more than 100 animal studies that link fluoride ingestion to brain damage and/or lowered IQ. According to the National Research Council (NRC) and the 2012 Harvard University comprehensive review of the studies, fluoride in drinking water, even at low levels, damages the brain and significantly reduces intelligence. Animal studies conducted in the 1990s by EPA scientists found dementia-like effects at the same concentration (1 ppm) used to “fluoridate” water; and

b) Risk to the thyroid gland. According to the NRC, fluoride is an endocrine disrupter. Most notably, the NRC has warned that doses of fluoride (0.01-0.03 mg/kg/day), achievable by drinking fluoridated water, may reduce the function of the thyroid gland for individuals with low iodine intake. Reduction of thyroid activity can lead to loss of mental acuity, depression, lethargy, and weight gain. Menstruation in fluoridated-water-exposed girls occurs an average of 5 months earlier than in unexposed counterparts; and

c) Risk to bones. According to the NRC, fluoride can diminish bone strength, make bones brittle, and increase the risk for bone fracture, a hazard to everyone. Bone-breaking falls are a major cause of death in the elderly; and

d) Risk for bone cancer. Animal and human studies–including a recent study from a team of Harvard scientists–have found a connection between fluoride ingestion and a serious form of bone cancer (osteosarcoma) in males ages 10 to 20 years; and.

e) Risk to kidney patients. People with kidney disease have a heightened susceptibility to fluoride toxicity. The heightened risk stems from an impaired ability to excrete fluoride from the body. Kidney impairment to some degree impacts one in eight people. As a result, toxic levels of fluoride can accumulate in the bones, intensify the toxicity of aluminum build-up, and cause or exacerbate a painful bone disease known as renal osteodystrophy; and

f) Studies have shown that fluoride toxicity can lead to a wide variety of serious life-altering health problems, including increased lead absorption, disruption of collagen synthesis, hyperactivity and/or lethargy, muscle disorders, arthritis, autism, Alzheimer’s, impaired sleep by impairing melatonin production by the pineal gland, inactivation of 62 enzymes and inhibition of more than 100 enzymes, inhibition of antibody formation, genetic damage, cell death, immune system disruption, damaged sperm, increased infertility, and liver damage; and

g) Dean Burk, Chief Chemist Emeritus, U.S. National Cancer Institute, said, “Fluoride causes more human cancer, and causes it faster, than any other chemical”; and

WHEREAS this SCVWD Board was provided in 2012 with actual copies of the fluoride research regarding the brain and intelligence but has, to a person, admitted in a public meeting, they have not read these studies; and

WHEREAS, for health reasons, residents will be forced to use reverse osmosis water filters to take “fluoride” out, as less expensive filters are ineffective for fluoride. These reverse osmosis systems are costly, waste three gallons of water for every one they filter, which defeats our water conservation efforts, and they nevertheless leave some fluoride in the water; and

WHEREAS, until the SCVWD can provide the toxicology data showing “fluoride” or hexafluorosilicic acid is safe, it is illegal to put it into our public water; and

WHEREAS, each individual possesses the inalienable right to NOT consume mass “fluoride” (hexafluorosilicic acid) medication--only possible if it is kept out of the common water;


We, the undersigned residents of and workers in Santa Clara County respectfully demand that the SCVWD Board Members:

• DISCONTINUE preparing to use our public water supply to deliver the medicine they term “fluoride” NOW.


• Recind the current decision and then PREPARE AND COMPLETE an Environmental Impact Report required by law prior to revisiting a decision to “fluoridate” our water supply.
