All,
I received a letter from Honorable Vice Chancellor Zurn yesterday afternoon. Vice Chancellor informed me that the Court accepted my letter as a Motion to Intervene. Below is a an exerpt from the letter:
"On April 13, the Court received a letter from Brian Tuttle concerning this
litigation.6
Mr. Tuttle asks the Court to accept his letter as a motion to intervene,
which I will do.
7
Because the motion must be resolved before the April 27
preliminary injunction hearing date, I will deem the motion unopposed unless an
opposition is filed on or before Monday, April 17. If any party intends to oppose
Mr. Tuttle’s motion, it should file an opposition by 3:00 p.m. EDT on
Monday, April 17. In the interest of time, any party filing an opposition should
send it and all related filings to Mr. Tuttle by email contemporaneously with the
filing. Mr. Tuttle’s reply must be postmarked or emailed to counsel by
Wednesday April 19.
The Court will take the motions under advisement without burdening the
litigants with oral argument."
