Subject: Expanding Presidential Pardon Authority to Include State Convictions
We, the undersigned citizens of the United States, respectfully petition Congress and the Executive Branch to enact legislation or a constitutional amendment granting the President of the United States the authority to issue pardons for state-level convictions under specific circumstances.
Background & Justification
Under the U.S. Constitution (Article II, Section 2), the President has the power to grant pardons and reprieves for federal offenses. However, this power does not extend to state convictions, which remain under the sole authority of state governors or clemency boards. This limitation has led to inequities and inconsistencies in the justice system, particularly for individuals seeking to restore their Second Amendment rights or overcome the lifelong consequences of past convictions that no longer reflect their character.
Many states have lengthy, unclear, or politically influenced clemency processes, leaving individuals without a fair opportunity to seek relief. Granting the President the ability to pardon state-level offenses would create a uniform system that ensures:
Consistent justice across all states
Fair and timely clemency reviews
Relief for individuals who have fully rehabilitated and demonstrated their ability to be law-abiding citizens
Restoration of fundamental rights, including firearm ownership, voting rights, and employment opportunities
Proposed Legislative or Constitutional Amendment
To ensure clarity and alignment with state processes, this amendment would establish a structured framework for federal and state cooperation, outlining the specific interactions between presidential pardon authority and existing state clemency boards. We propose that Congress enact legislation or introduce a constitutional amendment to expand presidential pardon authority under the following conditions:
Nonviolent and Certain Violent Felony Convictions – Eligibility should include nonviolent offenses and certain cases where violence was not a primary factor.
Time Requirement – Individuals must have completed their sentence and remained conviction-free for at least 10 years.
Full Restitution Paid – Any court-ordered restitution, fines, or legal obligations must be satisfied in accordance with federal guidelines under 18 U.S.C. § 3613(b), which imposes a 20-year limit on the enforceability of restitution orders.
Demonstrated Rehabilitation – Petitioners must provide evidence of employment, community service, or other positive contributions to society.
Safeguards Against Political Abuse The commission should be composed of legal experts, former judges, and representatives from both major political parties. The review process should include public transparency measures to ensure accountability.
