Petition to Classify Assault on Healthcare Workers as a Felony in New Hampshire

The Issue

To: The New Hampshire State Legislature

We, the undersigned, urge the New Hampshire State Legislature to enact legislation that classifies assaults on healthcare workers as felony offenses.

Healthcare professionals, including nurses, physicians, and support staff, are dedicated to providing essential care, often under challenging and high-stress conditions. Despite their critical role, they face a disproportionate risk of workplace violence. According to the U.S. Bureau of Labor Statistics, healthcare workers are five times more likely to experience workplace violence than employees in other industries, accounting for 73% of all nonfatal workplace injuries and illnesses due to violence. 

In 2019, a survey by the American Nurses Association revealed that 1 in 4 nurses reported being physically assaulted, highlighting the prevalence of violence in healthcare settings. 

Currently, 31 states have enacted laws making it a felony to assault emergency nurses, recognizing the need for stronger legal protections for healthcare workers. 

As an Emergency Room nurse in New Hampshire, I have personally experienced the consequences of inadequate legal protections. In February 2024, I was assaulted while performing my duties in the ER. Despite following all reporting protocols, my case remains unresolved, leaving me without justice and vulnerable to further incidents.

By classifying assaults on healthcare workers as felonies, New Hampshire would:

Enhance Legal Protections: Align with the majority of states that have recognized the necessity of stringent penalties to deter violence against healthcare workers.

Promote Workplace Safety: Foster a safer environment for healthcare professionals, enabling them to provide optimal care without fear of assault.

Support Retention and Recruitment: Demonstrate a commitment to the well-being of healthcare workers, aiding in the retention and attraction of qualified professionals in our state.

We respectfully request that the New Hampshire State Legislature take immediate action to amend state law, making it a felony to assault healthcare workers. Our healthcare professionals deserve the same level of protection afforded to their counterparts in other states.
