Subject: Petition Requesting Appointment of an Independent Agency to Administer Board Elections Under Radburn Regulations

Dear Members of the Centura Board,

We, the undersigned unit owners and members of the Centura Condominium Association respectfully submit this petition requesting that the Board of Directors engage an independent, outside agency to conduct and oversee all upcoming board elections in compliance with the Radburn regulations (P.L. 2017, c.106) and the New Jersey Department of Community Affairs’ (DCA) related administrative rules.

Given the importance of maintaining confidence in our association’s democratic process, we believe that entrusting election administration to an independent third-party agency will:

Ensure impartiality in the ballot distribution, and vote-counting process;

Prevent conflicts of interest by removing direct board or management control over election procedures;

Enhance transparency and trust among members regarding the integrity of the election; and

Ensure compliance with all legal requirements under the Radburn regulations and related DCA guidelines.

We therefore respectfully request that the Board:

Engage a qualified, independent election administrator with no past association to either the board or management company (such as a certified community election service provider or CPA firm experienced in condominium association elections); and

Publicly announce the name and scope of that agency’s responsibilities no later than [insert desired date, e.g., “30 days prior to the start of the next election cycle”].

This step will demonstrate the Board’s commitment to good governance and accountability while ensuring compliance with state law.
