Petition of the People in Pursuit of Justice for Noah Kenneth Bush

The Issue

The petition to redress herein charges the WCSO (Wayne County Sheriff’s Office, Wayne County, Georgia) and all its relative, superior authorities, with the burden of response and action.

Article I. of the Bill of Rights in the United States Constitution states:

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or the press; or the right of the people peaceably to assemble, and to petition the Government for redress of grievances.”[1]

“Redress” is defined by the Oxford English Dictionary as

A.    “Reparation or compensation for wrong or consequent loss.” 

B.     “To correct, reform, or abolish (a fault or an undesirable state of affairs).” 

C.     “To dress (a person or thing) again (in various senses).”[2]

We seek the fullness of the definition to be applied. Please find the Petition of the People in Pursuit of Justice for Noah Kenneth Bush herein, in junction with all historical complaints and relative future complaints filed against the Wayne County Sheriff’s Department, Wayne County, Georgia.

Due to the nature of this petition, we must also include known and unknown victims of the WCSO for the requested investigation(s) and indemnification(s) to result. These victims and families include, but are not limited to:

Grievances

1.      Failure to comply with the 1974 Privacy Act

It states:

“The Act requires agencies to “keep an accurate accounting” of information disclosures, except when the disclosure is made within the agency for routine administrative uses or made under the Freedom of Information Act (FOIA). The Act requires “each agency that maintains a system of records” to restrict the collection of information to only the information relevant to the purpose, to ensure the information remains accurate, to collect information directly from the subject whenever possible, and to tell the subject the purpose for which the information is being collected and the authority under which it is being collected. 5 U.S.C. § 552a(e).”[3]

We understand that legislative exceptions of the Act are afforded to law enforcement. However, this petition is required and necessary, in direct response, to the evident denial of the human right to life, equality, dignity, and the trustability of the officials to comply with codes and conduct. This is a failure to ensure the Constitutional protection of citizens by WCSO. Since this redress is in direct response to current and historical prejudice in the highest ranking WCSO officials, influence that is naturally inflicted on subordinates should be included in the investigation. Findings should be carefully analyzed and practically applied to sensitivity training, change in policy and procedure, and general support to successfully provide psychological and environmental safety for officers and those they are legally bound to protect and serve. 

The historically, racially charged, psychological and environmental safety connotations of the WCSO can be better understood at the reference provided.[4] To be clear, this redress is in response to the strongly evident, yet often improvable presence of racism and prejudice. However, the effects and affects, to individuals and people groups, of these constructs when allowed to govern the character of officials in their application of justice, is not only injustice, it presents itself as a form of egregious empirical injustice over time. Examples include acts of hate crimes, conspiracy, negligence, and noncompliance and/or violation to policy/code of conduct for law enforcement officials. 

Despite exceptions provided to law enforcement, case reports that involve murder should contain more than one sentence. We reserve the right to request all material, post investigation, to verify that the historical information obtained by the family of victims, matches the information submitted by the WCSO to superior, non-WCSO investigators.

It states:

 

“D. Investigations

1. Members will not interfere with cases being handled by other members of the

Department or by any other governmental agency unless:

a. Ordered to intervene by a supervisor.

b. The intervening member reasonably believes that a manifest injustice would

result from failure to take immediate action. When intervention occurs, a

report of such intervention will be made to a supervisor as soon as possible.

2. Members will not obstruct any investigation by destroying, altering, concealing or

disguising real evidence, or by planting false evidence or furnishing false

information to lawful authority.

3. Members who are the complainant or the target of a pending departmental

investigation or who have been questioned or have otherwise given statements

as part of the investigation will not discuss the complaint, their testimony or any

other aspect of the investigation while it is still pending except with a member of

the Office of Professional Standards, the person conducting the investigation, or

a member of the Staff of the Legal Services Office, unless directed to do so by

the Office of Professional Standards, Legal Services staff, or the Commissioner.

4. Members will not induce a witness or any other person who has knowledge

regarding any issue under investigation by the Department, or any other law

enforcement agency, to make false statements, withhold information, conceal

information, absent themselves or otherwise fail to cooperate with lawful

investigating authorities.

5. Members will not undertake any investigation or other official action not part of

their regular duties without obtaining permission from their supervisor unless the

emergency nature of the situation requires immediate police action.

6. Any member who has knowledge of actual or suspected criminal activities or is

about to conduct a criminal investigation must notify a supervisor verbally or in

writing and has an obligation to assist in the investigation if requested.

7. When a member becomes aware that they are the subject of an investigation by

a government agency other than the Department, they will immediately notify

their Commanding Officer or Division Director and inform them of the

circumstances surrounding the incident being investigated, the agency

conducting said investigation and what actions they have taken to resolve the

matter.

8. With the exception of personnel matters, members shall not submit to any

interview or give a statement concerning the performance of their official duties to

any officer or official of another agency, federal, state, or local, without first

informing their supervisor or other appropriate department official.

9. When a law enforcement officer or an agent from another law enforcement

agency requests a member of the Department to submit to an interview

concerning a non-duty related issue, the member shall inform the supervisor as

soon as possible.”[5]

4.      Potential violation and/or noncompliance of the FBI Uniform Crime Reporting (UCR) Requirements (and/or) deadlines to implement new policy implemented by Executive Order of the President of the United States in January, 2021.[6]

 

5.      Potential violation and/or non-compliance to implement and/or comply with mandated DEI, and/or sensitivity training to the African American/Black American people specifically, persons with special needs, BIPOC communities, and LGBQT+ communities, post Covid-19 sensitivity training(s), and all post 2020 election material implemented for law enforcement.

 

Resolution we are seeking:

This redress requests that the external investigations be held by each and all superior, relative, and applicable county, state, and federal authorities of the WCSO, and that those findings be subjected to independent and non-bias judiciaries without prejudice. At every level, we request that the findings be analyzed statistically and qualitatively, and further restitution be made to the deceased victims’ families where there is direct or indirect foul play. 

Internal

·         Immediate and indefinite removal of Sheriff Robert “Chuck” Mosley from all public office which he has been elected, with a disqualification status for future elections. 

·         Immediate suspension of involved officers in the case of Noah Kenneth Bush, and confirmation/status be provided to the families or representing attorney.

·         Immediate suspension of involved officers in other questionable cases pending investigation conclusion, and confirmation/status be provided to the families or representing attorney.

·         All evidence in the case of Noah Kenneth Bush be provided to the family or representing attorney.

·         All evidence in the other cases, where requested, with clear or suspected mishandling, suspicious handling, or violations in handling are present, be provided to the family or representing attorney. 

·         Where there is any future request on behalf of Wayne County citizens to investigate new or old cases further, that necessary steps are taken to ensure that they receive a new and unbiased investigation. 

·         Further immediate dismissals and/or reprimand of any law enforcement officers who are in gross, or variant violation of the Federal, State, and County codes, conduct, policies, procedures, and regulations. 

External

·         After compliance to the internal resolutions of this petition, we seek that the authorities charged with investigating the present and historical conduct of WCSO, cases in question, and questionable cases to come forward, be carefully selected by organizational superiors beyond individuals of competence, integrity, and anti-racial reputation. We ask that these parties have specific training and special handling in internal affairs. 

·         In the case of Noah Kenneth Bush, we request that all evidence, including video evidence known and rumored be thoroughly investigated and searched after, to include the parents/caregivers of involved minors and suspected minors so that children are not released into unsafe, abusive, or neglectful environments. 

·         An in person apology from Robert “Chuck” Mosely to the family of Noah Kenneth Bush. 

·         A donation from the WCSO be given to Noah’s football team and organization of Noah’s family’s choice.

·         A Public Memorialization in honor of Noah Kenneth Bush. 

·         Millcreek Circle be changed to “Noah’s Way”.

As you may be aware, mapping is a scientific approach that adjudicates between conflicting theoretical ideologies, pragmatic norms, and empirical shifts. The current and historical corruption and egregious mishandling by some members of the WCSO point to a clear, multifarious prejudice and discrimination. There is an urgent and critical reality that can be seen.

According to the Department of Review of the Transition of Law Enforcement Agencies to the National Incident-Based Reporting System (NIBRS),

“On May 25, 2022, President Biden issued the Executive Order on Advancing Effective, Accountable Policing and Criminal Justice Practices to Enhance Public Trust and Public Safety (E.O. 14074). Section 18(a) of the Executive Order calls for the Attorney General, in consultation with the United States Chief Data Scientist and the United States Chief Statistician, to submit a report to the President on the status of State, Tribal, local, and territorial law enforcement agencies transitioning from the Summary Reporting System (SRS) to the NIBRS in the FBI's Uniform Crime Reporting (UCR) Program.”[7] Subsequently, “As of January 1, 2021, NIBRS became the FBI’s national standard for law enforcement crime data reporting in the United States.1 NIBRS is now the only mechanism for reporting crime data to the FBI’s UCR Program. This includes reporting of violent crime, law enforcement assaults, and hate crime data. This is not just the Petition of the People in Pursuit of Justice for Noah Kenneth Bush, it is a seminal and critical attempt to avoid further infliction and affliction, that the oppressive, multifarious issues caused by prejudice, discrimination, apathy and noncompliance perpetuate. It is exactly trauma that is being inflicted upon many peoples who are being further disconnected and disempowered from life, and the choice to continue to look away from it. This petition posits accountability and resolution; that is, a viable offering of a mock form of justice to the victims of WCSO investigations. Your response(s) should reflect absolving root causes that are compounding, and multiplying current critical issues, and express safety for Wayne County citizens and officials. Our goals are the same.

In Noah’s case, there are many injustices and sensitivities, involving many families. My family will not receive their child back. This only provides further argument for all of Wayne County Officials, and all its superiors, to do what is necessary to become an entity that can be trusted to protect and serve. All involved officials should be held accountable for their actions. This is the people’s right to official service.

This petition to redress mandates your attention within our Constitutional right “to petition the Government for redress of grievances”. The redress requires the expedited attention, analysis, and action of all applicable superior levels of government whom are mentioned or unmentioned by investigating these egregious actions, noncompliance and/or violation of standards by some members of the Wayne County Sheriff's Office, Wayne County, Georgia.
