

Petition in Opposition to Rezoning Application ZA4283 ABAD Development LLC Forsyth Co., GA
The Issue
We, the undersigned residents, property owners, and concerned stakeholders of Forsyth County, Georgia, respectfully submit this petition in opposition to Rezoning Application ZA4283 filed by ABAD Development LLC.
The applicant is requesting to rezone approximately 3.442 acres located on Atlanta Highway (State Route 9) from M1 (Restricted Industrial District) to CBD (Commercial Business District) in order to facilitate a proposed retail, office, and warehouse development, including a Conditional Use Permit for a warehouse facility not to exceed 10,000 square feet.
Additionally, the applicant is requesting the following variance:
UDC 21-6.5(D)(1): A variance of 20 parking spaces to allow a maximum of 98 parking spaces rather than the required 78 spaces.
Basis for Opposition
We oppose this rezoning and variance request for the following reasons:
Increased Traffic and Congestion
The proposed commercial and warehouse development on Atlanta Highway (State Route 9) will significantly increase traffic volume, congestion, and turning movements in an already heavily traveled corridor, negatively impacting nearby residents, commuters, and local businesses.
Incompatibility with Surrounding Area
The proposed transition from M1 to CBD zoning, combined with warehouse use, is inconsistent with the character and intended development pattern of surrounding properties and may create adverse impacts on neighboring uses.
Parking and Infrastructure Concerns
The requested parking variance raises concerns regarding site intensity, overflow parking, traffic circulation, and pedestrian safety. Increasing the number of parking spaces beyond ordinance limits suggests an overly dense development proposal for the site.
Potential Noise and Operational Impacts
The inclusion of warehouse operations may result in increased truck traffic, loading/unloading activity, noise, lighting, and operational impacts that could negatively affect nearby properties and quality of life.
Precedent for Future Overdevelopment
Approval of this rezoning and variance could establish a precedent for additional high-intensity commercial or warehouse developments along the corridor that may not align with the long-term vision and planning goals of Forsyth County.
Community Concerns Regarding Scale and Intensity
The proposed development appears overly intensive for the size of the parcel and may place unnecessary strain on surrounding infrastructure and adjacent properties.
For these reasons, we respectfully request that the Forsyth County Board of Commissioners deny Rezoning Application ZA4283 and the associated variance request.
