Reject application for commercial car park infrastructure on Reserve 54615 being 48 Baker Street, North Lake, The Spanish Club of WA, City of Cockburn.

Grounds for Objections/Concerns:                              

1. No State Government (DPLH) or City of Cockburn council planning approval – contravention of the Planning and Development Act 2005.
2. Disregard by both council and state government in relation to resident’s rights.
3. Lack of transparency of this development infrastructure.
4. Transparency of potential transactions between the state government, City of Cockburn, WeBuild (the state government contractor for the new Women and Babies Hospital project in Murdoch) and the Spanish Club of WA.
5. Lack of prior consultation process to provide residents with the right for public comment or feedback.
6. Potential lack of required pre-construction studies undertaken – Geotechnical and Topographical Investigations, Environmental Impact Assessment (EIA) - Flora and Fauna Surveys, Hydrological and Hydrogeological Assessments, Topographic and Boundary Survey, Cumulative Impact Assessments, Traffic and Transport Impact Study, Acoustic and Vibration Modelling, Visual Impact Assessments, Utility and Services Locating, Aboriginal Heritage and Cultural Survey.
7. Lack of due process surrounding legislation, regulation, impact statements and consultation regarding the suitability/viability of a commercial car park on a regional reserve, abutting residential homes and the resulting impact this will have upon residents on a daily/nightly basis.

8. The non-disclosure and lack of transparency surrounding this development by government authorities has caused residents undue stress and resulted in structural damage to some homes due to the lack of consultative and due process being followed.  

9. Failure to openly and publicly advertise the development has resulted in the government effectively preventing residents with the opportunity to obtain and secure Dilapidation Reports to protect their properties subsequent to any earthworks commencing from a litigation and compensation standpoint.
