Petition for Judicial Review of Ontario’s OSAP Payment Pause
The Issue
The Issue
On October 6, 2026, Ontario announced a pause on OSAP payments to private postsecondary institutions while it investigated concerns about the programs integrity.
Students have been vocal in supporting accountability and the need to investigate the misuse of public funds. But legitimate students are now facing financial hardship, unexpected tuition bills, and now, the very real risk of losing their education over a funding disruption they did not cause.
Many students enrolled and began their programs relying on the funding framework in place at the time. They should not be left choosing between basic necessities and finishing their education.
What We’re Asking For
We are nowing calling on qualified Ontario legal counsel to assess whether the government’s decision can be challenged through a judicial review.
More specifically, we are seeking legal counsel to examine whether the pause was lawful, whether students’ circumstances were fairly considered, and whether urgent court relief or other remedies may be available at this time.
We are seeking:
- Judicial review: An independent legal assessment of the October 6 decision and any related actions.
- Protection for existing students: Fair transitional measures for eligible students already enrolled before the announcement was made.
- Urgent relief: Consideration of available legal options to prevent students from losing their education while the situation continues to be reviewed.
- Transparency: Clear explanations, approval criteria, and timelines for institutions under review.
- Fair treatment: Individual reviews for students facing serious financial hardship or the loss of their programs.
- Access to legal support: Coordinated or public interest legal assistance for students who cannot afford to challenge this decision alone.
This petition does not assume the government has acted unlawfully. It calls for independent legal scrutiny of a decision with serious consequences for students.
Students Support Accountability, Not Collective Punishment.
Students who followed the rules, qualified for assistance, and committed to their education should not be left paying the price for a system wide response without transparency, a fair process, or meaningful consideration of their individual circumstances.
Our Call to Action
We are calling on Ontario’s legal community to assess whether a coordinated judicial review is viable, identify potential applicants, and help affected students understand their rights.
If you are an affected student, legal professional, educator, or someone who believes government decisions should be transparent and accountable, please sign and share this petition.
Students should not lose the education they worked for overnight because of a funding decision they had no control over. We deserve answers, a fair process, and the opportunity to finish what we started.
