I’m writing this because this is something I care about deeply and it won’t happen without the support of people like you. Starting a petition isn’t something I would normally do, but my niece deserves Justice. I know I’m not alone and together we can make this change happen. Please sign and share!


I am urgently reaching out to you to seek your support in demanding a reevaluation of the grand jury ruling in the case of my niece, Ava Conklin. The outcome of the grand jury proceedings has left our family grappling with profound concerns about the fairness and justice in Ava's case.

 


On June 24,2023, Ava's life was tragically taken in a vehicular accident. Despite the gravity of the situation, the grand jury chose not to indict the driver on any felony charges. Instead, he is facing three misdemeanors with no jail time. This decision has left us bewildered and questioning the integrity of the legal process.

 


Ava had just gotten off work as a hostess at the Rockaway Hotel, located across the street from the accident scene. She was waiting at the bus stop for her sister because the two of them were planning to jump on the ferry into the city to have a picnic in Central Park. Tragically, it was at this very moment that Daniel Sails mowed her down, leading to her untimely death.

 

Daniel Sails claimed to have fallen asleep at the wheel because he worked all night. This is what the family was told by the 100th precinct officers, only to find out 6 months later that he didn’t start working until 10am that morning and the accident occurred at 2pm.  He was taken into custody and released later that night.

 

Witnesses from the scene have shared with us that Daniel refused medical attention at the scene, and some observed him falling asleep in the back of the police vehicle. Common sense suggests that adrenaline should kick in after such a traumatic incident, yet these observations question the accuracy of the initial assessment. How did law enforcement not recognize these potential signs?

 

 

Previous social media posts have come to light, revealing Daniel Sails and his girlfriend discussing the consumption of edibles, taking shrooms, and being high while filling his car up with gas. Though not recent, these posts speak to a pattern of behavior that raises serious questions about his judgment, responsibility, and ability to operate a vehicle safely.

 

 

Additionally, it has come to our attention that the driver's father is a retired corrections officer from Rikers Island. Disturbingly, we have learned that the 100th precinct allowed the driver to leave his cell to eat dinner that his family had brought him, even though Ava was tragically deceased. This raises serious concerns about the equitable treatment of individuals involved in this case.

 

 

In addition to these troubling details, Officer Smith refused to let Ava's father into the ambulance, displaying aggressive and nasty behavior. Her father was stripped of the opportunity to be with Ava during her last breath. Instead, he was told she would be going to Jamaica Hospital, and he rushed there to be by her side. To his dismay, he found out that she went to Brookdale, and despite his efforts to reach her as quickly as possible, it was tragically too late. A complaint was filed with Internal Affairs regarding Officer Smith's conduct, but regrettably, little has been done to address this disturbing incident. We demand answers and accountability.

 


This lack of transparency and access to crucial information compounds the grief our family is experiencing. We believe a thorough reevaluation is not only warranted but necessary to address these glaring concerns. We want ANSWERS!!! Answers from the 100th Precinct, Answers about Officer Smith, answers as to why Daniel Sails was never given a toxicology test and answers to how the Grand Jury could come to their conclusion of no felony charges.

 


This petition serves as a collective call to action, urging authorities to reassess the grand jury ruling, considering all available evidence and ensuring justice for Ava. Remembering Ava:

Ava's infectious smile and unwavering happiness were a testament to her remarkable spirit. Throughout her 19 years of life, she never lost that radiance, remaining a source of positivity and warmth to all who knew her. Though she enjoyed the simple pleasures of girlish pursuits, Ava cherished her time with family above all else, never considering herself "too cool" to be in our presence.

Ava possessed a deep appreciation for the world around her. She had an adventurous spirit and an open mind, eagerly embracing new experiences and embracing the beauty of nature. Her love for animals and her respect for the earth exemplified her compassionate nature and demonstrated the kindness she carried within her.

Ava was a true talent, gifted with an array of abilities that she nurtured throughout her life. From her early days at Rosie's Theatre Kids to her time at the Talent Unlimited High School, her heart was set on Broadway. With a passion for dancing, performing, and an angelic voice that could move hearts, she was a star in our eyes, embodying the essence of her family's Broadway legacy.

The impact Ava had on others extended far beyond her family. Her friends, the Hell's Kitchen community she called home, and the schools she attended, including her recent journey at Northern Vermont University, all mourn her loss. Her absence is a testament to the profound imprint she left on the lives she touched.

We will forever miss Ava's silliness, her infectious smile, and the warmth of her hugs. Her authentic and unpretentious way of life, not desiring materialistic things or conforming to societal expectations, serves as a powerful reminder for us to stay true to ourselves. Ava's love for thrifted clothes and her passion for music reflected her unique essence, one that celebrated individuality and embraced the world around her.

To know Ava was to love her. Her genuine nature, her unwavering kindness, and her compassionate spirit endeared her to everyone fortunate enough to cross her path. She was, without a doubt, too good for this earth.
