The Issue

Five dogs who live at 205 W Madison Avenue are often running loose, and are a nuisance to the neighborhood.  The dogs impede traffic, trespass, behave aggressively toward pedestrians, chase cyclists, and attack pets.  Fairfield Police Department has indicated Fairfield has no animal control, and they are not able to assist. The owner is in clear violation of city code 6.12.010, 6.14.040 (E), and possible violation of 6.14.050, 6.14.060.

Fairfield City Council should take action to ensure the pets' owner becomes in compliance with city code, or removes the dogs from the city.  Citizens of Fairfield should not need to protect themselves from packs of dogs when leaving their homes .

6.12.010 Running at large prohibited--Control device required. No dog shall be permitted to run at large on any street, alley, or public ground of the city of Fairfield, including but not limited to the B Street Trail, South Main Trail, Fairfield Loop Trail, city parks and city reservoirs, or to trespass upon any garden, yard or private grounds of any property owner, or any person not the owner or keeper of such dog within the city limits; and all dogs shall, at all times when not on the premises of the owner or keeper, be under the control of some person in charge of such dog by means of a rope, strap or chain securely fastened to such dog and held by such person so in charge or attached to the vehicle of such person in charge. (Ord. 1275 § 2, 2025; Ord. 442 § 1, 1962).

6.14.040(E) Fairfield Municipal Code Chapter 6.14.040 broadly restricts possession of dogs in such numbers that they cause disturbance of public peace. Hereafter, IT IS PRESUMED that, within the City Limits of Fairfield, keeping of dogs in numbers greater than four (4) mature animals per household, DOES CAUSE DISTURBANCE OF PEACE AND COMFORT in the affected neighborhood, and/or presents risk to public health. 1) Excepted are breeder dogs and kennel dogs (see B above) and 2) Dogs temporarily kept, for no remuneration, for periods less than twenty (20) days. 3) Dogs born to litter(s) not for commercial purpose, not yet mature, more particularly, younger than eight months. (Ord. 1250 § 1, 2024).

6.14.050 Sanitation of premises. All structures, pens, coops or yards wherein animals, domestic or wild, are confined shall be maintained in a clean and sanitary condition at all times, devoid of vermin and free from offensive odors. The city or its designee may, at any time, inspect or cause to be inspected any structure or premises, and issue any such order as may be necessary to enforce the provisions of this section, and any other relevant or pertinent rule, regulation of the board of health or any other health provisions of this code. (Ord. 999 § 2(part), 2004).

6.14.060 Cruelty to animals. No person shall impound, confine or cause to be im-pounded or confined in any place, any animal, domestic or wild, and fail to supply such animal during confinement with a sufficient quality (quantity) of food and water, adequate shelter and protection from the weather and opportunity for the creature to exercise. Nor shall any person poison, torture, deprive of necessary sustenance, mutilate, overdrive, overload, drive when overloaded, beat, maim, or kill any such animal by any means which shall cause unjustified pain, distress or suffering, including direct and deliberate corporal exposure of the animal to acid or any other corroding, irritating, or harmful substance with the intent to harm such animal, whether intentionally or negligently. (Ord. 999 § 2(part), 2004).
