Petition Against Kentucky's Proposed HB 140 Limiting Blood Donations
To the Honorable Members of the Kentucky Legislature:
We, the undersigned, strongly oppose House Bill 140 in its current form. This legislation, which seeks to restrict blood transfusions based on the presence of COVID-19 antibodies or "synthetic mRNA," would have devastating consequences on the state’s blood supply, jeopardizing the lives of countless Kentuckians who depend on blood transfusions for survival.
The Impact on Public Health:
Blood Shortages Could Cost Lives:
According to the CDC, as much as 96.4% of blood donors have COVID-19 antibodies. Restricting these donations would drastically reduce the available blood supply.
Blood is critical for surgeries, trauma patients (e.g., car accidents), cancer treatments, childbirth, and miscarriages. Limiting the donor pool could delay or deny life-saving treatments.
No Scientific Evidence Supports the Bill:
National medical authorities, including the FDA, American Red Cross, and Association for the Advancement of Blood & Biotherapies, confirm that blood from vaccinated donors is safe.
mRNA from COVID-19 vaccines degrades rapidly and poses no risk to blood recipients. The bill’s focus on "synthetic mRNA" perpetuates misinformation, not science.
Promoting Fear and Misinformation:
This legislation risks fostering unnecessary fear and mistrust in Kentucky's blood supply. Scientific consensus reassures us that all eligible donations, regardless of vaccination status, are safe and beneficial.
Additional Concerns:
Directed Blood Donations:
The bill promotes "directed blood donations," a practice deemed riskier and less effective by health authorities. Studies show directed donations may carry higher risks of infectious diseases and can delay critical treatments.
Healthcare Burdens:
The proposed regulations would impose significant logistical and financial strain on healthcare providers while doing nothing to enhance patient safety.
Our Request:
We urge you to reject or amend HB 140 to remove any provisions restricting blood donations based on COVID-19 antibodies or vaccination status. The health and well-being of Kentucky residents must come first. Lives are on the line, and this legislation, as written, would put countless patients at risk.
Your constituents count on you to uphold science, protect public health, and ensure the availability of safe, life-saving blood donations. Please oppose HB 140 and any similar legislation that could endanger lives.

There is also a provision preventing sale of blood for pharmaceutical production if there are hospital shortages.
