Petición para el sobreseimiento inmediato de los cargos y la liberación de Ernesto Ricardo Medina y Kamil Zayas Pérez, miembros del Proyecto El4tico

A la Fiscalía General de la República de Cuba y a la Fiscalía Provincial de Holguín:

Nos dirigimos a las Autoridades para expresar nuestra profunda preocupación por la detención de *Ernesto Ricardo Medina y Kamil Zayas Pérez, miembros del proyecto audiovisual El4tico*, ocurrida el día 6 de febrero de 2026, así como por la posterior imposición de cargos penales y la medida cautelar de prisión provisional.

Es bien conocido que Ernesto Ricardo Medina y Kamil Zayas Pérez son creadores audiovisuales independientes cuyo trabajo se ha centrado en contenidos de carácter filosófico, humorístico y reflexivo. Sus producciones se han mantenido consistentemente dentro del ejercicio pacífico de la libertad de pensamiento y expresión, reconocida en la Declaración Universal de los Derechos Humanos, el Pacto Internacional de Derechos Civiles y Políticos, y el artículo 54 de la Constitución de la República de Cuba.

Somos plenamente conscientes de que las opiniones expresadas por Ernesto Ricardo Medina, Kamil Zayas Pérez y sus invitados pueden no ser del agrado del Gobierno o del Partido Comunista. Sin embargo, la libertad de expresión no puede ser legítimamente definida, restringida ni evaluada en función de las preferencias personales de los funcionarios públicos, ni en función de su concordancia con las posiciones oficiales.

La protección de la libertad de expresión existe precisamente para salvaguardar opiniones que puedan resultar críticas, incómodas o no conformes.

En este sentido, los cargos impuestos contra Ernesto Ricardo Medina y Kamil Zayas Pérez resultan infundados e incompatibles con las protecciones constitucionales e internacionales de la libertad de expresión, y por tanto su detención debe considerarse arbitraria.

Por lo tanto, exigimos firmemente:

1. El sobreseimiento inmediato de todos los cargos contra Ernesto Ricardo Medina y Kamil Zayas Pérez.
2. Su liberación inmediata y la restitución plena de su libertad.
3. El pleno respeto a las garantías constitucionales de la libertad de expresión y al debido proceso.
4. El cese de cualquier medida penal o punitiva en su contra por el ejercicio pacífico de sus derechos fundamentales.

Petition for the immediate dismissal of charges and release of Ernesto Ricardo Medina and Kamil Zayas Pérez, members of Proyecto El4tico  

To the Office of the Attorney General of the Republic of Cuba and the Provincial Prosecutor’s Office of Holguín:  

We address the Authorities to express our deep concern regarding the detention of Ernesto Ricardo Medina and Kamil Zayas Pérez, members of the audiovisual project  El4tico, which occurred on the 6th february 2026, and the subsequent imposition of criminal charges and the precautionary measure of provisional imprisonment.  It is wellknown that Ernesto Ricardo Medina and Kamil Zayas Pérez are independent audiovisual creators whose work has focused on philosophical, humorous, and reflective content. Their productions have consistently remained within the peaceful exercise of freedom of thought and expression, recognize in the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, and article 54 of the Constitution of the Republic of Cuba.

We are fully aware that the opinions expressed by Ernesto Ricardo Medina, Kamil Zayas Pérez, and their guests may not be agreeable to the Government or to the Communist Party. However, freedom of expression cannot be legitimately defined, restricted, or evaluated based on the personal preferences of public officials, nor on whether such opinions align with official positions.

The protection of freedom of expression exists precisely to safeguard opinions that may be critical, uncomfortable, or non-conforming.  

In this regard, the charges imposed against Ernesto Ricardo Medina and Kamil Zayas Pérez to be unfounded and incompatible with the constitutional and international protections of freedom of expression, and therefore the detention must be considered arbitrary. 

Therefore, we firmly demand:  

1. The immediate dismissal of all charges against Ernesto Ricardo Medina and Kamil Zayas Pérez. 
2. Their immediate release and restoration of their full liberty.
3. Full respect for the constitutional guarantees of freedom of expression and due process. 
4. The cessation of any criminal or punitive measures against them for the peaceful exercise of their fundamental rights.
