The developer responded to your inquiry on 12/2/22 and in pertinent part told you that:
"The buffers associated with the identified offsite stream, drainage, and wetlands do not project onto the subject property or the proposed sewer extension area. As such, it appears that the subject property and proposed offsite sewer easement area would be unencumbered by any potentially regulated wetlands, fish and wildlife habitat, and/or associated buffers."
Previously the developer has made similar allegations which have been refuted. The developer and PDS know or should know that this assertion is without foundation. The offsite sewer would be a little over 1,000 feet which would require the destruction of the colonnade of trees on either side of it and would necessarily impinge and encumber and destroy the buffers. Please look at the report of Sarah Cooke dated June 2, 2020. Based upon her survey and analysis, Dr. Cooke concluded:
"It is my opinion that PDS must not approve the site plan application under PFN: 19-115780-SPA and that it be remanded back to the Applicant for revision. As stated above, as currently proposed, this development will result in significant, unmitigated impacts to critical areas (Wetland, drainages, and their buffers; and significant trees. The Silver Lake Water and Sewer District is encouraged to rescind its Development Agreement with Ambleside pending resolution of the issues raised in all the 3rd party review documents. The County must tie the SEPA impacts from the sewer line construction into the entire permit review process."
Review of Dr. Cooke’s report reveals that her opinions and conclusions are factually and scientifically based. In addition to the damage and destruction to the critical areas and buffers the developer’s plan would also encumber and destroy private property as documented in Dr. Cooke’s report. Subsequent to Dr. Cooke’s report you are aware that your database now acknowledges another F4 fish bearing creek running north/south from my property over the Dunbar property which connects to the Silver Lake Creek (F4 fish bearing). Please be advised that these creeks reside in an established wetland. The newly established fish bearing creek requires new culverts which are fish passable. Keep in mind that this creek runs right through the area where the developer would apparently propose to build a sewer.
On April 15, 2022 and March 17, 2022 you will see where engineer Bill Lider outlines in precise detail the unfeasibility and failure of the proposed sewer that would cause and result in irreversible damage and destruction of the critical areas including the urban forest colonnade as well as damage and destruction to private property.
Please note that Engineer Bill Lider has provided you with previous reports in this matter analyzing the destructive nature of this plan and significant negative impacts it will cause to the watershed and buffers. Rather than needless to say given its obviousness, there is all the more reason to reiterate that the fish, wildlife and habitat would face their demise.
The developer’s position is clearly unsupported by the evidence and therefore must be rejected.
