Here is WSDOT’s answer (In red)  to my inquiry and engineer Bill Lider’s response  (in blue) to that.  As you can see, our interest is to preserve the WSDOT wetland with an upland to include a salmonid critical area creek.  This was intended by law and made a mitigation site in perpetuity. That means forever. This is our public land.  For over a year we have asked for entry to this land to obtain a proper delineation of the wetland buffers.  It was only our effort this past year that finally forced PDS, the developer and maybe even WSDOT to recognize that the Silver Lake Creek at the north of this property is a fish bearing salmonid creek entitled to special protections. Before that, WSDOT and PDS knew of this as early as 2001. Now WSDOT is saying the developer's Stormwater Report is okay when you simply can’t make that conclusion when there is no rational basis for WSDOT to approve it this way. Read this for yourself and decide.
