

HELP ANIMALS IN KAZAKHSTAN
The Issue
The animals are deemed to be "a thing" in the Republic of Kazakhstan as per national legislation. It could be ok, if private property protecting concept would work. But unfortunately, law was amended many times and nowadays is written in such a way that it is very difficult to sue someone , even if your dog was killed. There are articles in the law, but administrative issues are reviewed not in the court, but by local municipal authorities ("akimats") who create "specialised veterinarian organizations" authorised for catching and killing stray dogs and cats. These organizations catch not only stray dogs and cats, but also pets belonging to somebody. It is useless to say, that stray dogs and cats are out of the law de facto. By the way, there no term definition for stray dogs and cats on the law, as well as we do not have definitions for animal shelters or special hotels for them. In 2017 at InterParlamental Assembly of CIS countries the Model Law on Animal Responsible Treatiment was accepted. This law stated humane principles, but it has advisory nature and not obligatory. Kazakhstani Association for Animal Protection Inucobo submitted the law project developed on the said Model Law in December 2018. However it seems, that the government does not see the necessity of having such law. Many cases with involvement of professional lawyers and attorneys were lost. Cases of killing dogs in Nur-Sultan, of died dog in the car of employee of such special veterinarian organization in Almaty, case of killing Alexander Novikov's labrador in Aktobe, case of killing the dog in Taraz in the eyes of his owner - little girl, who is asking now where is her dog...
