Last month animal-rights activists from Norfolk-based People for the Ethical Treatment for Animals came to rural Accomack County, allegedly took a family's pet Chihuahua from a porch and euthanized it. 

The dog's owner, Wilbur Cerate, called police and the PETA workers, both from Virginia Beach, were charged.

"I'm angry," said Cerate

Accomack County Commonwealth's Attorney Gary Agar said there wasn't "criminal intent," and he won't prosecute the alleged crime.

A PETA spokesman could not be reached. It has denied requests by other media outlets for comment.
