The Issue

Our father is facing an unimaginable situation where he stands to lose everything due to a court decision that has awarded 100% of the marital estate to his ex-wife, as well as a pathway for her to seize a premarital asset that rightfully belongs to him. This decision is unjust and devastating, leaving him potentially homeless and living on social security. This has been a almost 7 year scorched earth legal battle whereas the court has repeatedly emboldened our father's ex wife with double pay, awarded all property assets to her including an income producing property. 

The property in question known as 502 Court Street is not just any asset; it's a premarital one that my father had before entering the marriage and was court ordered to be awarded to Craig. This property has been in our family since 1960. Our father's ex wife was in contempt of court pertaining to this issue and the judge failed to enforce his own ruling pertaining to the property division. According to a recent court ruling, this property is now at risk of being sold, with proceeds entirely bypassing my father, despite it being a part of his families legacy.

We are actively pursuing an appeal to correct what we believe is a severe misjudgment. We have retained an appeal attorney that comes highly recommended. However, if the property is allowed to be sold before this appeal process is completed, my father will irreparably lose a significant part of what should be his financial stability in his elder years. 

The legal system should ensure justice and fairness without stripping individuals of their rights to appeal and protect their rightful possessions. The potential sale will cause irreversible damage, both financially and emotionally. The order that came down from now retired Justice Merrell awarded Craig's ex wife the entirety of the marital estate. THAT MEANS ZERO attempt at any decision upholding NY STATE LAW of EQUITABLE DISTRIBUTION.
