Pause Beacon Point construction
The Issue
PAUSE BEACON POINT: Protect Our Community Before Construction Moves Forward
To the Nueces County Commissioners Court and relevant Texas state agencies:
We, the undersigned residents, parents, property owners, taxpayers, and concerned citizens of Nueces County, respectfully request that all legally available steps be taken to pause discretionary governmental approvals, incentives, agreements, or other governmental actions facilitating the Beacon Point Data Center until the ongoing State of Texas data-center review is completed and the potential impacts on our community have been publicly addressed.
This is not a petition against technology, economic development, or responsible investment in Nueces County.
It is a petition for transparency, accountability, and responsible development before—not after—our community is affected.
WHY WE ARE ASKING FOR A PAUSE
The Texas Department of Licensing and Regulation currently lists the Beacon Point Data Center at 4650 FM 1694 in Nueces County as a privately funded new-construction project encompassing approximately 657,130 square feet, with an estimated construction cost of approximately $399 million and a listed construction start date of September 28, 2026.
At the same time, the State of Texas is conducting heightened review of large data-center development.
On September 21, 2026, Governor Greg Abbott directed the Texas Commission on Environmental Quality to halt permits sought by data centers until ERCOT completes its audit and stated that state agencies should not move forward with regulatory approvals related to data-center development until required information is obtained.
The State’s review is examining many of the same questions residents deserve to have answered locally—including electricity demand, water resources, infrastructure costs, setbacks, noise, lighting, traffic, emergency response, and impacts on surrounding communities.
If these questions are important enough for the State of Texas to demand answers, they are important enough for the people who live beside this project to receive answers too.
WE ARE ASKING FOR:
A pause on discretionary county action facilitating Beacon Point while the applicable state data-center reviews and audits are pending, to the extent permitted by law.
No new county tax abatements, incentives, reinvestment-zone agreements, or other discretionary public financial assistance for Beacon Point until the Commissioners Court publicly considers the results of the state review and the project’s community impacts.
A publicly noticed meeting or hearing specifically concerning Beacon Point, where residents can receive information, ask questions, submit evidence, and have their concerns entered into the public record.
Public disclosure and discussion of Beacon Point’s anticipated electricity demand and electrical infrastructure requirements, including what infrastructure will be required and who will ultimately bear those costs.
Public disclosure of anticipated water demand, water sources, cooling systems, and water-conservation measures.
Independent consideration of potential noise impacts, including continuous mechanical equipment, generators, transformers, cooling equipment, and low-frequency noise, with appropriate mitigation and enforceable standards where legally available.
Evaluation of setbacks and impacts on nearby homes, schools, children, and surrounding neighborhoods, including Calallen-area communities.
Disclosure of backup-generation plans, anticipated emissions, emergency-response requirements, lighting, construction traffic, and long-term traffic impacts.
Full transparency regarding public incentives or financial benefits requested or received in connection with Beacon Point.
A clear public explanation of which permits and governmental approvals Beacon Point currently possesses, which remain outstanding, and how the State of Texas’ current data-center directives affect this project.
WE ARE NOT ASKING NUECES COUNTY TO CHOOSE BETWEEN PROGRESS AND OUR COMMUNITY.
We are asking our government to ensure that progress does not come at the expense of the people who already live here.
Once a project of this magnitude is built, many of its impacts cannot simply be undone.
Residents should not have to discover the consequences after construction begins.
We deserve transparency.
We deserve answers.
We deserve meaningful public participation.
And we deserve to know that the long-term interests of Nueces County residents are being protected.
We therefore ask Nueces County officials and all applicable state agencies to use every lawful authority available to ensure that Beacon Point does not move forward through outstanding governmental approvals or public support until the required reviews are complete and the community’s questions have been publicly answered.
