

Assembly Bill 638 was a “Red Flag Proposal” It called for extreme risk projection orders that would allow for the temporary removal of guns when people are in imminent danger of harming themselves or others. Under the bill, either a law enforcement officer, a family or household member of the person may file a petition with a court to request an extreme risk protection injunction. If a court grants the injunction, it would be effective for up to one year and may be renewed. The proposal would make it a felony offense for someone with an active injunction to possess a gun. This bill had 38 sponsors and was assigned to the Committee on Criminal Justice and Public Safety last October. It never had a public hearing, a necessary step to moving forward out of committee. Advocates who work with domestic violence victims say this measure is needed to bring state law in line with federal law Wisconsin's lawmakers ended their legislative session in March and are not expected to resume work until January. I’m hoping to go in front of legislators in 2023 during a legislative hearing, and advocate for Henry, to let them know how the Extreme Risk Protection Orders - Red Flag Laws are needed in Wisconsin.
