The Issue

In June 2023, my son, Noah Sotomayor, was born at just 22 weeks gestation, facing insurmountable odds with only a 3% chance of survival. From the moment he took his first breath, I have been in a constant battle to give him the chance to live. One of the most challenging moments was when Noah needed to be transferred to another hospital that could provide the necessary treatment that his current hospital could not. Despite having an accepting hospital ready to receive him, I encountered immense resistance from the treating hospital, prolonging a critical week-long struggle to secure his transfer. This should not have happened.

Unfortunately, Noah's struggle is not unique. Many families face similar obstacles when seeking timely transfers for their critically ill loved ones due to bureaucratic challenges or hospital policies. This delay in transfer can sometimes mean the difference between life and death. As it stands, there is no streamlined and independent review process to expedite such transfers, leaving patients like Noah in perilous situations.

We propose the implementation of "Noah's Law," which would establish a streamlined, expedited, independent review process for instances where a critically ill patient has been accepted by another qualified hospital that believes it can offer treatment or evaluation not available at the current hospital. Noah's Law would ensure that when lives hang in the balance, patients receive the timely care they need without unnecessary delays.

The evidence is clear: timely access to specialized care increases survival rates and improves health outcomes for critically ill patients. According to data from the National Institute of Health, streamlined patient transfers between hospitals can reduce mortality rates by up to 30%. Implementing Noah’s Law could save countless lives by ensuring that no critically ill patient is denied the urgent care they need due to bureaucratic red tape.

Through this petition, we are calling on healthcare policymakers, hospital administrations, and key legislators to recognize the urgent need for change and to act on behalf of those who cannot fight for themselves. Imagine being in a situation where a transfer is the only hope for your loved one, who could otherwise not make it. Let us come together to change this system for the better.

Join me in fighting for the rights of critically ill patients by signing this petition today. Let's make sure that every patient has an equal chance for the best possible outcomes. Together, we can prevent the heartache of unnecessary delays and honor the fight and spirit of Noah Sotomayor. Please sign and share this petition to bring our cause to the attention it deserves.
