The Issue

Dustin Fender was a vibrant young individual whose life was abruptly taken due to the inhalation of a chemical air duster—a product available in numerous retail stores across Indiana. Dustin's sudden cardiac arrest was caused by the chemicals in these air dusters, substances readily accessible to anyone, including our vulnerable youth.

This tragic event was preventable. Dustin's story is not just a personal loss for his family and friends; it is a call to action for all of us in Indiana. We must address the easy availability of chemical air dusters, which are often used for purposes other than their intended use, sometimes with deadly consequences. Young people often fall victim to peer pressure or curiosity without fully understanding the risks involved with these household products.

Currently, many retail outlets in Indiana display these products on open shelves, making it effortless for minors to purchase them. This accessibility poses an unacceptable risk, one that cost Dustin his life, and one that endangers everyone else's. We cannot stand by and allow another life to be cut short due to preventable circumstances.

We are advocating for "Dustin’s Law," a legislative measure that would require retail stores in Indiana to place chemical air dusters behind the counter. This action would not only make these hazardous products less accessible but would also send a strong message about their potential danger.

Statistics from the National Inhalant Prevention Coalition indicate that more than 22.9 million Americans have used inhalants, with a significant percentage of these individuals being younger than 18. These alarming figures underscore the critical need for regulation to protect our youth. By implementing behind-the-counter sales, we mirror the successful strategies used to control the sale of other hazardous products like tobacco and alcohol.

Passing Dustin’s Law would safeguard Indiana’s community by preventing misuse and potentially saving lives. We are not just fighting for the memory of Dustin Fender; we are fighting for every family who could otherwise experience a similar loss. Let us act now to create a safer environment for our children.
