Pass "Chance’s Law" to Close Fatal Traffic Investigation Loopholes in Virginia

The Issue

In the early morning hours of Sept 13th 2025 in Powhatan County, our lives changed forever when my beloved son, Chance, was struck and killed by a vehicle. Mine as well as my entire family’s lives have changed forever. The driver left the scene and later returned. Because of massive loopholes in Virginia law, the responding state trooper failed to give the driver a breathalyzer or any toxicological test, and failed to conduct a proper state accident reconstruction.

Left with no answers, our family was forced to fund a private lawyer as well as a private reconstruction investigator, out of our own pockets. That forensic investigation proved the state’s scene management was so severely botched that our local prosecutor was left without the evidence needed to pursue criminal charges. The driver walked away without a single test, a single infraction and our family was denied justice.

When we took this tragedy to our local representative, Delegate R. Lee Ware, he showed absolutely no interest. We refuse to let Chance’s memory be ignored, and we refuse to let another Virginia family endure this nightmare.

We are taking "Chance’s Law" directly to the Virginia Senate and the House Courts of Justice Committee. This bill will strip away officer discretion and mandate two critical changes:

    1    Mandatory testing: Automatic drug and alcohol screenings for any driver involved in a crash causing serious injury or fatality to the pedestrian.

    

2    Mandatory reconstruction: Automatic deployment and full forensic reporting by a certified state crash reconstruction team for every pedestrian fatality.

Chance was denied a proper investigation, but his legacy can protect the next family. Please sign this petition to demand Virginia lawmakers sponsor and pass "Chance’s Law".
