PACtUp - Fighting Homophobia & Transphobia in Real Estate
The Issue
RESOLUTION
Whereas the National Association of REALTORS® (NAR) created and champions Article 10 of the Code of Ethics (COE), which enshrines equality in housing into our professional creed; and
Whereas The LGBTQ Real Estate Alliance was founded to protect the rights of LGBTQ+ people in the real estate arena and the REALTORS® and professionals who work in the industry; and
Whereas multiple state governments and the federal administration have weaponized policies, legislative bills, and laws against the LGBTQ+ community by attacking our rights to marry, adopt, exist as non-criminalized people, and to live without fear of search, seizure, harm, and or harassment; and
Whereas marriage is a property rights issue with spouses having rights to property owned prior to the marriage, rights to own property jointly and to insure such property, the right to be involved in the sale of such property, and rights of inheritance if one spouse should pass; and
Whereas the re-criminalization of homosexuality and the criminalization of transness will create impediments to renting, buying, selling, and otherwise transferring and owning real estate; and
Whereas the re-criminalization of homosexuality and the criminalization of transness will create impediments to holding licenses as real estate professionals; and
Whereas NAR stats show 62% of home buyers were married couples; and
Whereas NAR's political action committee (RPAC) has historic and policy biases which support bigoted, homophobic, transphobic, misogynistic and xenophobic candidates, in flagrante disregard to our own Article 10 rule; and
Whereas NAR claims that the PAC is a separate organization and thus can not be held to COE standards, however:
- PAC boards and committees are filled with REALTORS®
- The meetings of the PAC are held in REALTOR® offices
- Fundraising is overtly and covertly added to renewal bills for our REALTOR® dues,
- PAC fundraising is discussed in every REALTOR® meeting,
- Those who challenge the PAC or suggest changes are ostracized by NAR's local and state boards; and
Whereas members of local PAC committees who advocate for implementing Article 10 rules around candidate endorsements are required to donate and fundraise for homophobic, transphobic, misogynist, and xenophobia candidates if they are outvoted in committee meetings, thus being forced to fund their own disenfranchisement to participate; and
Whereas the REALTOR® PAC promotes that donations go fairly to members of both parties as a distraction when presented with the facts that many of their candidates are in flagrant violation of Article 10, regardless of party; and
Whereas the REALTOR® Association was recently caught funding a charity, American Property Owners Alliance (APOA), which donates heavily to ultra-conservative candidates with little transparency; and
Whereas local and state REALTOR® Associations have started charging "Mobilization" and "NAR Image" fees with no transparency as to where those funds go; and
Whereas the Leadership and Staff of the LGBTQ+ Real Estate Alliance have been more concerned with gaining NAR acceptance than defending and advocating for our community; and
Whereas the Leadership and Staff of the LBGTQ+ Real Estate Alliance have been quiet accomplices in discrimination by controlling the conversation, keeping activist out of meetings, and keeping the community "in line" with NAR objectives;
Be it resolved that those signed to this petition will:
Defund the REALTOR® PAC and urge others to stop donating until Article 10 of the Code of Ethics is a required position for candidates who seek our funding and endorsements.
Advocate loudly and persistently for transparency on association fees for "mobilization" and "image" categories and for transparency in the American Property Owners Alliance donations.
Express our Vote of No Confidence in the current Officers and Employee Management of the LGBTQ+ Real Estate Alliance.
