These bots can complete purchases in milliseconds and bypass queues leaving real fans and collectors unable to obtain products at retail prices. Box stores like Target are also not implementing policies or procedures that prevent the use of bots on their platform, while simultaneously doing late night product drops (12am PST), which the bots clean up.

This problem extends beyond just the world of Pokémon. Automated checkout bots are a pervasive issue affecting numerous consumer markets, from sneaker drops and gaming consoles to concert tickets and limited edition merchandise. The consequences are dire, as they drive prices on secondary markets to exorbitant levels—often three times the manufacturer's suggested retail price (MSRP). This not only exploits consumers but also undermines the efforts and investments of legitimate brands and companies.

The use of automated checkout bots for e-commerce websites should be outlawed at all levels: federal, state, and local. In doing so, we would ensure fair access to products for all consumers, not just those with the means to employ technology to their advantage. Legislation needs to be enforced to curb this growing problem, safeguarding consumers and maintaining market integrity.

There are successful precedents for controlling unfair purchasing practices. For instance, regulations against ticket scalping have been implemented in various jurisdictions, leading to more equitable access to event tickets. Similar legislative action should be taken against automated bots to prevent market monopolization and price manipulation.

I implore legislators and leaders to act swiftly and decisively. Enacting laws to prohibit and penalize the use of automated checkout bots is a necessary step toward preserving the integrity of our e-commerce landscape. Consumers deserve the right to purchase goods without having to compete against unfair technological advantages.
