Opt-In Cannabis Retail Dispensary in Perinton, NY

The Issue

The Town of Perinton NY, has decided to Opt-out of marijuana Retail and Consumption lounges. On March 31st, 2021 NYS became one of the latest states to legalize adult-use/recreational marijuana with the signing of the Marijuana Regulation & Taxation Act(MRTA). Municipalities cannot prohibit the legalization in general; residents can still possess and consume within the municipality. Our Town supervisor, Ciran Hanna, posted a comment in November 2021, which stated that they choose to opt-out simply because the town could opt-in at any time. 

The time is now! 

Business Intro:

The 420 Shop Inc was the 4th CAURD application to be sent into NYS. With the lawsuits delaying any progress in issuing licenses, we were shocked to finally receive the conditional license over 2 years later. We have had an extremely difficult time finding a location that fits the distance restrictions from schools, churches,  youth centers as well as proximity protected locations listed on NYS Site. Our village of Fairport opted in however, this is a very condensed area of retail spaces, and there is 1 pending location which has locked down the entire village, based on current proximity restrictions. 

Population: Within & Surrounding towns

Village of Fairport: 6k

Town of Perinton: 46k (opted out)

Town of Pittsford: 30k (opted out)

Town od Webster: 51k (opted out)

Village of Fairport hosts many events and festivals through out the summertime. Our main festival is canal days which brings about 150k people into town in a single weekend. With surrounding towns opted-out and many traveling through Perinton to attend, it would be an incredible advantage for Perinton to move forward with Opting-in to retail dispensary. 

Community Benefit:

 Those municipalities that do decide to opt out will not be eligible to receive any of the revenue generated from adult use marijuana sales; a local excise tax imposed on the sale of cannabis products from a retail dispensary, to a cannabis consumer at 4% of the product price. This tax is distributed to local government's based on where the retail dispensary is located. This 4% is broken down into 2 percentages; 25% of the tax revenue goes to Monroe County and 75% would go to Town of Perinton. Municipalities that choose to opt out, however can opt into the retail market at anytime.  Marijuana legalization is intended to Boost our economy and drive tax revenue. With tourism, banking, food, real estate, education, construction and transportation being just a few of the industries that will benefit from legal marijuana. With your support and signature we can help the city come to a beneficial concussion and Opt-in.
